Good day all,

I got married outside of Canada, only to find out it was all a scam from his end as he has another woman here now (how convenient)

Where would I need to go to change the status? Already done it on CRA website.

Is the Marriage valid? can he remarry someone here for status to stay? His status expired and I am no longer responsible for him already checked with Immigration.

I am just looking where to I go to find more information, online didn't help and already checked with my Province's vital statistics who advised I would need to contact Federal Government as it's not a Canadian registered Marriage.

I just want this nightmare to be over. Wedding took place in South America to which I am not travelling due to covid-19.

Assuming you were married according to the laws in South America, yes, the marriage is valid.

You will need to file for divorce to dissolve the marriage. Before you can file for divorce, you will need to first be separated from him for a full year.

The marriage remains valid until some authority takes an action to annul it or enact a divorce; in practical terms this means it's valid until you divorce him through the procedures in the relevant province. See a lawyer.

There's not really such a thing as a "Canadian registered marriage" at the federal level; it's a provincial matter.

If you do not/did not sponsor him, there's no further issue for you with respect to immigration. Whether he can remarry or stay, that's his issue, not yours - but certainly he can't remarry until divorced.

Mind there are other issues in divorce like assets that have nothing to do with immigration, but for that - see a lawyer.

Yes the Marriage was valid as I have a booklet from South America showing the marriage etc.

With this having to file for divorce after being separated for a full year, when will this have to be filed? South America? Or can you do the process here in Canada.

From what I know laws in South America are different when it comes to filling for a Divorce.

You would file for divorce in Canada and follow Canadian rules for the divorce process.

Any idea where to seek a lawyer for advise, the one here for a consultation she wanted 400$ which to me is a little steep especially when wanting to inquire only.

Vital Statistics already told me that it's not their jurisdiction. Thank heavens I didn't sponsor him he was only here on a Visitor Status which has since expired, and thanks for clarifying no longer any issues with regards to immigration for me.

You need to hire a family lawyer. This is an immigration forum so probably not the best place to get a recommendation. I would recommend that you look around for a family law forum where you might be able to find recommendations for legal assistance. Good luck.
