Hi Everyone,

So we are in the process of common law sponsorship since i am in mid divorce but plan to be married as soon as my divorce is completed (the end of April if all goes well). So what my question is ....

Has anyone here gone through this process ? I understand in some states you need to be divorced for one year before being able to be married, has anyone come across this situation. Did you use a representative ? What was required to be filed before hand ? Any complication ?

My finance is Mexican from Jalisco state, and I am canadian. Any info from anyone that has done this would be most apprecaited, we would love to start working on this well we wait for our sponsorship so we have something else positive to focus on :)
 
I am confused... are you applying for common law sponsorship now or waiting until you are married to apply for spousal sponsorship?

We are already in process of applying common law, We lived in Canada together for well over a year but he was sent back to Mexico on a exclusion order.

I have been seperated from my ex husband for 4 years, we are almost to be divorced, another month or so, at first we expected the divorce to take longer so my lawyer advised we go ahead with the common law sponsorship and inform CIC when we change our status to married.
 
In the state of jalisco you need to wait a year.. but I am confused, have you already sent in your application?

Yep, we have just sent our application for common law sponsorship as of this week as per our lawyers recommendations.

Do you know if riviera nayarit is the same ? regarding wait time from divorce ?
 
Hrmm.. it might just be best to wait until he is back to get married since you will have to wait a year from the date you are officially divorced anyways! OR find a state where it doesnt have that requirement and get married there :)

No idea! You never really know with mexico b/c its so hard to find information (having a bad day today with mexican policies :() maybe you can call the local office of a state close to jalisco and find out the requirements.
 
OR ask in the mexico thread, someone there will prob know the answer

Thats what I was just thinking ! Hmm well that changes our plans a bit, we will most likely still get married there since it will be easier for his family, its very cheap for us to fly to PV or GDL but very expensive for them to come here and also to apply for visas ect ... which is why we agreed on a wedding in mexico so we could celebrate with both families.

Well i must say this little technicality is quite disapointing !

We feel and will do the same (get married in Mexico for the same reasons) and are also applying common-law..You could always do your ceremony there (jalisco), and then the legal wedding in another state!!

Thats not a bad idea ! I am off to research what states dont require a one year from divorce, I will post my findings !
 
mexi, I found this link at the bottom lists links for each site but I first clicked on Nayarit and it was all in spanish which i am not fluent in but maybe you are...

Unfortuantely I am still working on the whole fluent in spanish thing, not as easy as I originally thought ! Well i am getting conflicting information all over the place, it seems if you were not previously married in mexico or if you are not a citizen you do not have to wait the one year, but then i also read several other points that say you do. I read that Chihuahua. Quintana Roo and Puebla possibly dont have this requirements but hard to verify it.

Apparently marrying a mexican citizen in Mexico is not easy, it would be far easier to be married in Canada and celebrate in Mexico with a fake ceremony, so my next question, what do you think the chances are for my fiance to get a visitors visa for a marriage ceremony after his one year exculsion order (Its up in August)! lol I am pretty sure they are not good, but hey you never know !
