Just found out my wife was 3 months pregnant a week after I landed. The baby isn't mine as we haven't seen each other for 6 months. I no longer want to be with her. Do I just leave Canada or should I inform CIC formally that we're getting a divorce? My PR is conditional. I've been in Canada for 3 weeks, not even a month.

Leave her and go on with your life , don't inform CIC and don't leave Canada .

I hope what you advised is legal? If not it is the kind of actions that makes this process so hard on the rest of us.

The OP has Condition: 51 on his COPR. If he's no longer with his sponsor, he could have his PR revoked for non-compliance, if CIC finds out.

To the OP...I'm sorry to hear that you've been blindsided like this from your wife.

Wouldn't this be a case of "abuse/neglect" by the sponsor though? If the sponsored person informs CIC, even if they have conditional PR, they could be allowed to stay in Canada because it is not their fault they were misled.

I dont think this qualifies as abuse.

Also, the OP should not be staying in Canada after this marriage breakdown, as this is fraud since they are no longer together. Also why would he want to stay here anyway? He already indicated he wants to leave, and the sole reason he came here was to be with his wife, now that the marriage has broken down, there is really no reason to remain here as the whole premise of coming to Canada was to be with his spouse.

I'm just sayin'. If he did want to stay in Canada, after all most people are giving up a lot coming to Canada. I've heard of people in the US being granted a pardon (immigration policy is similar in this regard) because their spouse (the sponsor) cheated on them. May be worth a shot if willing to go through the trouble.

No problem with him wanting or trying to stay in Canada just do it legally. Counseling illegal behavior is not good for any of us.

you can always apply social assistance. your wife was supposed to sponsor you for 2 years. it's her fault for cheating. at least money can come in. it's not your fault.

Infidelity is illegal in Canada so I don't think you'll be forced to leave the country, but if you do move back I'd look into how hard it will be to Divorce form your home country. Eventually, you may want the divorce. If that's easier to do here, might wanna think about that.

What makes you think that infidelity is illegal in Canada?

To clarify: infidelity is not illegal, but may be grounds for divorce.

hey guys.. but if he divorces.. he gonna lose an opportunity to stay in Canada. dont they have like legal aid society or something? in B.C, i think if your income is below a cutoff; you can call a 1-800 something and speaks to a legal aid person' usually a law student/internship person. i remember i called them when i was laid off to give me some legal advice regarding the severance package.
pretty sure you can ask for immigration law.

lol...if that was the case, a lot of married people would be breaking the law!
