Hello Everyone,

We will be mailing out the package soon, we have few questions that we are struggling with. I'm sponsoring my wife she is in Florida and I'm in Mississauga, doing it outland.

1) IMM0008 - Question 4 - Immigration Office - Which one do we put? I am so confused, my wife is a US citizen so do we put Buffalo, Newyork or would it be Mississauga? where I'll be sending in the everything
2) FBI Clearance - can we submit everything without the clearance? I have read online that we can but that we have to notify them that its in the process, how do we do that?

1) Your immigration office is CPP-Ottawa. Buffalo closed last year so all U.S. outland applications are sent through Ottawa.

2) I don't see an issue with sending before you receive the FBI clearance I would just put a letter in with the package that you have sent for it and you will have it sent in as soon as you receive the clearance. Somebody with a bit more experience or a senior member here could probably be of more help on this one. I wouldn't sweat it though.

Good luck and be patient, it can be a long painful experience but remember that the payoff is unquestionably the greatest thing you can have happen.

Make sure you mail it to Mississauga, but Ottawa is the American VO..... for some reason. (Ottawa is ours now, mwa ha ha?)

You risk having your application returned without the police clearance. You also risk having them delay the process several months while they wait for you to supply it. People have had their applications returned for not supplying the clearance at the time of mailing. The timelines posted by CIC are for a complete application. This includes your police clearance. If you don't include it, you cannot hold them to the 13 months ;)

That being said, many people have sent the police clearance in later and had no issues. Many have gotten their COPR well before the 13 months as well. Some people who included their police clearance had to resend it because CIC managed to lose it. There is no "right" answer. I personally wouldn't send in the application without the clearance, but it's really up to you what you do.

So it's CPP Ottawa even though my wife's nationality and country of residence is US? Just want to confirm. I had no idea buffalo office closed so thank you!!!

Oh - about the FBI clearance, it's only valid for 90 days and to get the sponsor approval takes about 90 days so by the time they go to the second phase it will expire. Do I still send one before I'm approved or after ???
 
It's 90 days by receipt. Meaning you must mail it within 90 days. Once CIC gets it, it's valid for a year. Just make sure you mail it in quickly. It doesn't what stage they get it at. The only thing is I would NOT mail it to Ottawa VO until you have confirmed they have your file.

Yes, the USA actually won the War of 1812. It's not a well known fact. We own Ottawa, but to be nice, we let Canadians pretend it's theirs.

I am an Indian citizen and currently in US on H1B visa. My wife is Canadian citizen.
I want to know that which office should we select for phase 2., NYC or Delhi?
We want to get done with this immigration process asap so that we can start living together.
Whats the latest time for both the places (I want to know the real time experience, not what they mention on CIC website)??

Please help...

If you reside in a foreign country for at least 1 year before applying, you can choose to be processed by the VO that handles apps from that country (for the US it's Ottawa, not NY). Bear in mind that, in case they call you for an interview, you must go to the VO that's processing your file.

The processing of your application can take a lot less than the estimate provided by CIC on the website (http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp) or a lot more. It all depends on your case. There is no mandatory timeline, so there is no way you will know beforehand. By providing all the informations as requested and a lot of proof about the relationship you can ensure that your app will go as fast as possible.
