LMIA Working with the Same Employer

Hello there,

I have the following situation. I'm the Postgraduate Work Permit holder. I'm working for the same employer for more than 2 years in NOC B, 2281(IT Specialist) occupation. My work is on a full-time basis and no time term (permanent employment).

Is it possible to get an extra 50 points for the job offer I have explained above? What I've read from the current forum that PGWP(Open work permit after graduation) holders should gain LMIA to get 50 points despite the fact that they are already working for the same employer.

So, above saying, the employer should post a job ad and make sure that they won't be able to find a Canadian for the role I'm in. For me, it doesn't make any sense because I already work with them for more than 2 years.

I saw this article which is confusing me:
https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/documents/offer-employment/lmia-exempt.html

Does anyone had a similar situation, were you able to get an extra 50 CRS for the job offer with the current employer without applying for LMIA?

Thank you in advance!

The answer is no since you hold a PGWP.

This is a very common question here and the rules are very straight-forward.

Your employer needs to obtain an approved LMIA in order for you to qualify for the 50 points.
