lmia to open work permit

hi

I am 38 years old indian male working in mumbai and got job offer from a toronto based startup. Company is offering me lmia and my concern is that lmia closed visa is very restrictive and so i want to ask about when is earliest I can get open work visa.

How will it work? will I need points. I am more concerned as I am 38 years old. Also I have wife and 3 year old kid.

You aren’t eligible for an open permit even after working in Canada. If you apply for PR through Express Entry and get an ITA, and your permit is expiring, you may be eligible for one then. However if you are using the job for points, you are expected to work for them a year past PR.

As said above, open work permits are only granted in specific situations, such as once you've been selected and applied for PR.

It would be best to assume that you will need to work for your employer on the closed work permit for at least at least 2 years before you will qualify for an open work permit.

Given your age, it's quite possible you will need to rely on the job offer and LMIA you have with your current employer in order to get PR. So switching employers may not be possible for you until after you have become a PR.

Your wife will qualify for an open work permit when she travels with you to Canada.
