Yes - you can apply for a work permit without an LMIA. However unless the LMIA is approved soon, the work permit is going to be refused.

ThNk you for a great answer, Q2: my coworker still has a paycheque but his permit expired last jan 30. (feb1-15 cut off) he cant cash the money. Now he stop working

I don't understand your question - sorry.

did you mean your friend is scared to encash her paycheck because she is already expired?

Sorry ok i will make it clear as i can, he's work permit expired jan .30 2015, but he still work feb1-15. Then his salary is in cheque. He cant deposit to his account.

If your friend knows of a Canadian Citizen, they can sign their paycheque over to them and then give them the cash if they are worried, people do it all the time, just dont make a habit out of it.

I cashed a cheque when my visa expired and was waiting for my LMIA and havent encountered any problems.

Yes, no one want to sign the cheque coz they afraid if the government check their account.he told that he must be put in jail of helping other with that situation

I doubt 1 cheque in amass of millions will raise any red flags.

Your call though.
