Hi all,

I came to canada as a student, finished my 2 year diploma, has 9 months (Bell) + 9 months (Modi Technologies) experience in NOC 2282. Now I work for Trinity Aerospace as IT Support Specialist NOC 2282, and my employer agreed to provide me with LMIA. Median wage for NOC 2282 in Toronto is $30. But my current salary is not even near that amount. I have consulted a lawyer and he said I can't even think about LMIA if I dont meet that wage. What are my options for LMIA. I will create profile for PR next month with above experience and my current employment is Fulll-time permenant. Can someone explain a bit on my situation.

Thanks in advance

The lawyer is right. Your wage needs to be at least the median wage for the LMIA to be approved. If your wage is lower than the median wage - this guaranteed the LMIA will be refused.

Your options for an LMIA are for your current employer to increase your wage to meet the median wage - or to find a new employer who is willing to give you a job offer, pay at least the median wage, and go through the LMIA process.

Is there any way I could extend my work permit. It expires next year August, I will be applying for PR through express entry as mentioned above. Can I bridge my work permit while a decision is made on Express Entry with my full-time permanent job offer?

To qualify for a bridging open work permit, you must have already been selected through Express Entry (i.e. received ITA) and have submitted your application. Right now you need to have around 460 points to be selected out of the pool. How many points do you have?

Otherwise you need a job offer and approved LMIA to extend. You cannot extend based on your full time job alone.

Right now I havent created a profile yet, I am waiting for my IELTS results, using CRS tool, my score is around 430-450 depending on IELTS scores I put in.

Currently the only document I have to support is a Full-tme permanent job offer.

The job offer does not allow you to extend your work permit unfortunately.

Also note that you cannot claim the 50 job offer points under express entry with just the job offer. You need an approved LMIA from your employer to claim these 50 points. Make sure you have not included these 50 points in your EE score.

Eligibility requirements if you apply from inside Canada
  • you’re waiting on a decision on an application for permanent residence from inside Canada
This is one of the eligibility for extending work permit, can you explain a bit on this, here is the link to this page https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporary/eligibility.html

Thanks in advance

As previously explained, to qualify, you need to have already received ITA and have submitted your application. If you are simply in the EE pool but haven't been selected, you don't qualify. In that case you're not waiting on a decision in your application. You haven't even applied yet.
