Hey everyone,

I'm hoping to get some clarity on this situation. I have an approved LMIA for an in-home caregiver and the candidate I want to hire is currently a visitor in Canada. Based on the new rules, if she applied for a work permit through me as an employer, would it get approved? There's a lot of conflicting information.

On one side, I saw that most cases the person who you want to hire must already reside in Canada with some sort of work/student permit. But then there are other articles saying because the LMIA is already approved, you can hire someone "abroad" which in this case would be my candidate since she's a visitor here at the moment.

Do you live in Quebec? That's the only scenario that will allow you to hide her.
