LMIA Foreign Worker Confirmation

Hey everyone,

I'm hoping to get some clarity on this situation. I have an approved LMIA for an in-home caregiver and the candidate I want to hire is currently a visitor in Canada. Based on the new rules, if she applied for a work permit through me as an employer, would it get approved? There's a lot of conflicting information.

On one side, I saw that most cases the person who you want to hire must already reside in Canada with some sort of work/student permit. But then there are other articles saying because the LMIA is already approved, you can hire someone "abroad" which in this case would be my candidate since she's a visitor here at the moment.

What new rules? Rules haven't change. Now that you have LMIA, your employee must be eligible.

So no a visitor would not be eligible unless you live in Quebec and applying outside Canada. If so assume she has language tests, ECA for related education and work experience. She is also not a family member.

Do you live in Quebec? That's the only scenario that will allow you to hide her.
