Our LMIA is expiring end of July. Apparently even though there was no lottery for FSW since march, they cannot extend our LMIA further than July since it will be 9 months. can someone provide any help to this problem? It's not our fault that due to COVID there was no lottery, but the Canadian government doesn't seem to understand this problem.
 
I am eligible for LMIA based PR in FSW category but if FSW draws havent been happening since March I am stuck and my LMIA letter is expiring soon
 
Your LMIA letter doesn't have to be valid. You need to have a work permit and be working for that employer and have a job offer letter from the employer offering you a job for at least a year after you become a PR.

Expect the LMIA the OP has is only valid for PR and not dual intent - so no option to apply for a work permit.
 
We are directly applying for a pr since i have a job offer already. It is clearly mentioned in the lmia letter that this positive lmia is valid only till July 28th. Only after the lottery can we go ahead.. is there any way or place where we can talk abt this extension?
 
We have to give pr residency application which can only happen after the invitation .. which will happen only after the lottery.

How many points do you have under Express Entry?
 

OK - so that means you must have submitted your Express Entry profile after March 4th (otherwise you would have received ITA already). Too bad you missed out on the first 4-5 months of the LMIA validity.

Ask your employer if there is a way they can apply to extend the LMIA. Your employer would need to be the one to extend the LMIA - not you.

There is always some chance their may be a FSW draw in July (impossible for any of us to say of course).

Or you can ask your employer to obtain a new LMIA. This time they should really get a dual intent LMIA so that you can also qualify for a work permit.
