Can anyone count the work experience towards CEC while waiting for the approval of WP based on LMIA for NOC B and study permit holder at the same time? @legalfalcon

When you apply to change your WP, your are on implied status and you can continue to work and use this experience. If a temporary resident applies for renewal of their work or study permit and their permit expires before a decision is made, paragraph 186(u) and section 189 of the Immigration and Refugee Protection Regulations (IRPR) (the right to continue working or studying under the same conditions pending a determination of their application for renewal) apply only as long as the person remains in Canada.

I was on Study Permit not work permit when I applied for LMIA based work permit. In that case, can I count it towards CEC or not. @legalfalconWhen you apply to change your WP, your are on implied status and you can continue to work and use this experience. Thank you. But, it was not a PGWP. It’s LMIA based work permit as a Temporary Foreign Worker. And, I didn’t complete my studies as it was in between the academic year when I got positive LMIA from my employer and then applied for employer specific work permit. @legalfalconYou can work full-time while waiting for a decision on your post-graduation work permit application if, at the time you submitted your application, you:
- had a valid study permit,
- had completed your program of study,
- were eligible to work off-campus without a permit, and
- did not work off-campus more than 20 hours a week during academic sessions.

Thank youIf you filed for a change of status from student via to WP, then unless your WP is issued you cannot work.
ThanksIn that case any work before the work permit was approved was unauthorized and cannot be counted towards PR.
