I am here to sympathise with all of you who got rejection at interview or without. No one has right to question whether your relationship is genuine or fake because they don’t know anything about it. I am a strong believer that only love can put two people together and it is up to them to live their lives the way they feel like. However when it comes to sponsor our loved ones who are outside of Canada, we face a huge roadblock that has it rules and regulations before let anyone to pass through it. And that is Citizenship and Immigration Canada. I would like to stay with spousal sponsorship’s side and tackle some stuff which makes some of us not to pass that roadblock. To begin with, I have learnt so much in this forum and study different cases that are in this forum. I understand how you are feeling right now but there is hope for someone who still breathing. You still have a lot of chance to win your cases once you start your appeal process. But I am addressing to those who have not yet started their sponsorships or to those their applications are still at Mississauga Ontario. You can still do something for your files at this stage they are right by supporting the spousal sponsorship with unlimited proofs that can make you skip the interview. I will put some facts that I took from this forum and it really opened my brain and see how CIC works in different parts of the world.
I came up with these statistics according to the number of cases that I have come across either for approvals or rejections. There is 40% of Applicants who got rejected when their files were In Process without them knowing. Because those applications have a lot of holes in themselves and so much inconsistencies when it comes to supply the right information and let that information keep flowing so that the IO will confirm beyond reasonable doubt that your relationship is genuine. Our files go through a systematic process of CIC and if by any chance those files which have holes comes on the CIC‘s balance they will prove themselves. There are a lot of areas that the visa office looks at when files are going through preview by the first IO and a review by a supervisor. They break down the sponsorship in two as we all know. The first part they study is the genuineness of the relationships between the sponsors and their sponsored ones, for example, do you have a plan set up once you will be together? How have you shared responsibilities between wife and husband? How do you understand by entering into marriage and know it values? Or do sponsor wants to bring people in Canada? They looked at what you have achieved together as a team before this marriage start, they will scrutinise how you understand the responsibilities of children in your marriage once you will be together. They will check to see if you both understand the definition of a relationship and how you embrace it as a couple. I have a friend of mine and he elder brother worked for Immigration long time and he said that they had a principle that everyone who knocked at the immigration’s door is 100% a lire and it is up to you and your files to prove that you are genuine. I believe you see what they mean by relationship is not genuine and 90% of times they already taken a decision during in process by judging and sentenced the files for an approval or rejection. For a rejection they may make you come to an interview with their Decision already made and when the applicants go there it will be just formalities because they have to keep record that during such year we interviewed a certain amounts of people some failed and other passed. You don’t need a lawyer to tell you these things because he or she will ask you money but there are intelligent people in this forum that can help others than a lawyer would. Secondly, they will focus on the applicant. Your intention to migrate to Canada, your age and language skills, your work experience before coming to Canada because they need skilled people in Canada to keep their economy growing. That is what they need to invest in you as human capital by granting you that visa. They will check your past through worldwide Interpol security systems if your name will come up. They will check your family’s too even if they are not coming with you. For example, if one name of your brother or sister comes up as a threat to one country that will get CIC’s attention to get a good scrutiny on you but I did not say they will reject you because of your brother’s case.
Furthermore there is 20% of Applicants who got rejected at the interview simply because they did not have solid proofs that tie them to their sponsors and make their relationship genuine. 98% of rejections in this forum are due to relationships are not genuine; please visit those threads of Appeals in this forum you will understand what I am talking about. There are few things I will mention of what they check for a genuine relationship between the sponsors and the sponsored people. For instance, they look at age differences in comparison with your culture and the place where you come from. It is true that they know there are true marriages where the age difference is significant but the sponsors and applicants had solid and heavy proofs which can drive away the officer’s doubt. So if you fall in this category before you apply make sure you look for heavy points which will tie both of you. They will look at difference in religion to see if one was force to join another religion at the marriage ceremony and why?
Another 10% of Applicants who succeeded their interviews because the officers were undecided until they meet the applicants to hear from them then grant a visa right there or reject them. These cases are slightly common in this forum as I have spent days and days studying different applications results.
Without forgetting 30% of those Applicant who took time to plan, prepare, research, study their files vs. what CIC is looking for, and at the end their files moved so fast and interviews were waved. In these 30% of approved relationships I could guess there are 15% of fake marriages that were approved because both the sponsors and their sponsored people studied the sponsorship itself which those people in a genuine relationship don’t usually do simply because they believed that their relationships are genuine so CIC will know that it is genuine too. But it always turn out to a surprise because they did not 1) Plan for that sponsorship before it is sent to CIC,
2) Research for legitimate information that CIC want, 3) Study their files to see where there are holes and regions of doubts that can raise red flags in the officers’ minds and cover those holes by powerful statements if evidences are not there.
4) Seasoning the applications with 10 or 5 even 20 pages of a written document which will explain more what the forms cannot. By seasoning I meant that make your applications interested and captivating for the person who will work on your files.
Advice: don’t rush in filling forms because you want to start sponsorship, but take even 3 months to plan that sponsorship, research for golden nugget that CIC wants in order to sell your application quickly, choosing of words and powerful statements. I will put some supporting documents that you should provide when sending your applications.
Passports showing that sponsor left Canada and entered the applicants’ country
Flights itineraries round trip in the name of the sponsors
10 good photos showing the sponsor and applicants at the airport happy together with other people.
10 good photos showing families around the sponsor and applicant
10 good photos during civil marriage at the registry with the officer who perform it and 5 other after the process. In all the photos sponsor and applicant must be happy to show CIC that it is a part of your life.
10 clear good religious marriage at the location that you chose.
10 photos showing the garden or at the reception and food has to be visible and people who attending
Pictures of gifts they were given and those people have to stand with you too in those poses.
Pictures of families members who attended the wedding.
15 good Letters showing the span of time you wrote that so that CIC can see how you keep that relation growing with time, 15 emails, 20 phone bills, 10 Skype details, Facebook chat. Make sure they see that the whole year of 2012 how you communicate with date and time on those emails facebook and so forth.
They have see affections photos between Sponsor and Applicants.
10, 15, or 20 pages letter explain how you have set up plans once you will be together in Canada. How you have decided to share responsibilities as husband and wife, what achievement have you accomplished together before marrying and in the future if you stay together you will do more achievement which will make Canada to profit of them. How important do you see yourself together in Canada as couple, what is your nearest plan in 2 years as couple, 5 years and 8 years,
A copy of your wedding invitation, 5 good photos at the airport showing when you left the applicant’s land back to Canada.
Bills of the hotels you spent your honeymoon.
3 months bank statements of the applicant showing how much he gain saved to prove CIC that you can still work and support your family in Canada based on that bank statement evidence you provided.
Was the name of the wife changed at the marriage? If no, why?
Do you have a join account? If yes put it, if no supply anything to make them see that you guys are serious.
Reference letters from 3 friends and 3 family members showing that they were aware of your relationship.
Marriage certificate alone is not a good prove of a genuine marriage but few of these things will help you skip an interview.
