Hello everyone,
Does anyone have recent experience with a less complex case being moved to a regular hearing after submitting documents and receiving a letter for a regular hearing?

My background check was received in both the IRCC portal and my lawyer’s IRB portal in November 2025. Since then, I haven’t received any updates from the IRB regarding either a hearing date or an approval without a hearing. When I called the IRB last week, an officer called me back the next day and told me that my file is with the scheduling team for a hearing.

I recently met someone from my country of origin who was in a similar situation but received a positive decision without a hearing. What are the chances of receiving such a decision versus being scheduled for a regular hearing? Also, how long does the IRB usually take to schedule a hearing after receiving the background check?

Do we need to submit any additional documents before the hearing? I have already submitted almost all the evidence of persecution in my home country to the IRB during the file review process. Can my lawyer or I request another file review from the IRB? Thanks.

If you have received notice that you will be getting a full hearing you’ll be getting a full hearing. You can add additional information before your hearing. Speak to your lawyer. Would not compare to other asylum claimants. Being from the same country doesn’t mean you have similar applications.

I have a similar situation. My case was considered for less complex in April 2024 and was moved back to regular hearing. I still have not received a hearing date as of today…..maybe it’s just luck but I would suggest you buckle in cause it might be a while. ‍♀️

Once granted with a less complex case, it usually goes two ways according to my latest experience. Once your lawyer notifies you that you've been granted a less complex, which is a good thing in itself, the next step after is that you're required to send evidence to substantiate your BOC and once compelling credibility is established, usually you're not required or called upon for a hearing.

The second part is if the evidence sent is not compelling enough to convince IRB members not to do so, you're granted a short-hearing, you're are given a notice to appear for a virtual short hearing for your refugee claim to filling the missing gaps that are not consistent with the BOC, and a date is scheduled, usually the short hearing takes roughly 1 and half to 2 hours and once the missing gaps in the BOC are answered consistently, then the member has the discretion to decide to grant you protected status or not with reasons as to why they think so upon carrying out due diligence of there own that you deserve protection.

Additional evidence during the short-hearing, is sometimes called upon in regards to previous back and forth text messages with a key witness back in your home country to ascertain the facts in your storyline, and if you need time to extract the important snapshots, and if you agree, you're given a fixed timeline to do so, they might give you a week or two to came up with and present it. And depending on the legal statues in your home country that severely persecute people according to what the subject matter is in your BOC, your legal representative can suggest to download the laws or news paper articles that decry the BOC as additional evidence and present it to counsel if need be to further solidify your case that your life is in danger if sent back to your home country.
