Hi Leon,

I would like to ask for some advice on what are the possible options for the PR card of my wife. We have landed in Canada and became permanent residents on Oct 2010. After several days of stay, we went back to UAE as it is was not yet financially viable to stay in Canada, and my wife was 2 months pregnant at that time.She delivered in UAE on 2011 for our 2nd child. We had then decided that I will have to come back to Canada in 2012, find a work and once stable, they will follow. Since my wife also has a good job in UAE, we have agreed that she will support me while I'm still searching for job. However, due to some unavoidable circumstances, it is a blessing thou, my wife was again pregnant and delivered on December 2012 for our 3rd child.We have again decided to postpone our return. Me and my first child came back to Canada on August 2013. Our first child is now studying and is in the 2nd grade. My wife visited Canada last September 2013, just to check our place and the school, but went back as we still have to children left. Here are our possible options:

First option: Sponsor my non PR children. And once we have the approval for the PR of the kids, my wife will return to Canada with them, before expiry of her PR card. My question: Once she gets reported for not meeting the 2 year requirement, is taking care of non PR card kids, outside of Canada a strong ground for humanitarian appeal. Assuming that my non PR cards kids gets approval to become permanent residents.

Second option:My wife will return to Canada before October 2015, and just pray that she doesn't gets reported by immigration. Once she gets in, she will stay for 2 years w/o renewing her PR card. I will apply for sponsorship of my non PR kids once she has completed the 2 years requirement.

Please advice leon on which option is possible for us. Thank you for your help.
 
Enzo, it sounds like you meet the RO for your PR so you can start sponsorship of your children right away if you haven't already. If your wife gets reported and if she loses her PR due to that, you can sponsor her too. Having stayed outside Canada with a non PR child would probably protect her PR. Still, if she is not reported, all she has to do is stay 2 years and then she can renew her PR card normally.

If she wants to bring the non-PR chldren to Canada and join you now, she could apply for a TRP for the children to bring them along. That is a type of temporary visa given on H&C grounds. She would say that it is very stressful on your family to be separated and stressful on her to be alone with 2 children. If the TRP is granted, she could bring the kids to Canada now.
 
Thanks for the prompt reply.Greatly appreciate your advice Leon. One thing more, Once I apply for sponsorship of our 2 kids, will they find out that my wife will not meet the 2 years requirements? or application for the kids will be taken separately. Thank you

When you apply to sponsor your kids, you will give your history, not your wife's so they will only check if you meet the RO.
