I have been a Permanent Resident since October 2021 which means I am still in the three year period where I cannot accept Social Assistance. My question is if I accept Legal Aid for a Family Lawyer is that considered accepting social assistance?

Whether you qualify will depend on your salary and savings and your future ex’s salary and savings. If he has been the primary breadwinner he will usually be ordered to cover your lawyer’s fees if he has savings. Qualifying for legal aid for things like a divorce is difficult.
