My sister had her landed immigrant status in 2002 (has her SIN and health cards). She did not stay in Canada, and moved back to Hong Kong. She now wishes to live permanently in Canada, and purchase a condo in Toronto. What must she do regarding notification / application?

To fly to Canada she would need to apply for a PRTD which given if she has failed the residency obligation where she needed to have lived in Canada for minimum 2 years in 5 years before each new entry it is possible that in applying for a PRTD her PR status could be revoked subject to appeal.

Alternatively she could avoid applying for a PRTD and enter through the US land border but may still be reported that way leading to status being revoked.

If she manages to enter the country without being reported she would need to stay in Canada for a minimum of 2 years before renewing a PR card.

Whether she keeps her PR status can depend on reasons for not meeting the residency obligation such as looking after a sick relative for example but not financial or employment reasons.

Does your sister still qualify for immigration? She should really research her options because after beinf out of Canada for over 15 years she is likely to get reported or be refused an RTD. She may not be able to stay in Canada for 2-3 years straight without leaving if she gets very lucky and somehow doesn't get reported if she enters via a land border.

She can buy property here pretty much no matter what. Her status only affects how she will finance the property and what down payment is required (if she is getting a mortgage).

I'm not familiar with what "landed immigrant" status means, but if she is a Permanent Resident, then she can buy a property in Canada. There are institutions that'll give her a mortgage with as little as 5% down (if she is working, but no credit history) or 35% down (not working, no credit history). It really depends on her case.

If she doesn't have status in Canada of a PR, then she will be considered a foreign buyer. Minimum 20% down payment is required at most banks to give mortgage. On top of that she may be charged a 15% foreign buyer tax. But if she gets PR within 3-4 years, then she can apply to get that foreign buyer tax refunded. Pretty sure that buying a condo is related to living in Toronto. Doesn’t sound like she is willing to buy the condo if she can’t live in Canada as a PR. Your sister never qualified for a healthcare card if she left before stating 6 months.
