Good Day to all of you!
Honestly, I am just new on this site and reading all the posts and replies from the users made me decide to post and ask from you guys...(especially to those seasoned ones!),your infos are so helpful...
I am about to get the services of a law firm based in Canada in getting PR in Canada.I submitted an assessment and they said that the assessment is favourable...Though there are some questions in my mind that may somehow complicate my application.My questions are: Right now I am out of status working in California,although my employer put me in a sponsorship to work. I submitted my papaers thru an attorney to obtain labor certificate and up until now the papers are still in process...Will there be any implication of being out of status if in case i apply for PR in canada? and, Will it be possible if I include my family in the application who happens to be in the Philippines?or start the application just for me and apply them later on?

CIC is not concerned about out of status, but it depends where you can apply from - So if you were here in the US for a year or more and kept legal status for that time period then you can apply form the US Buffalo office. If you cannot prove it through I94 etc. then you cannot apply from USA, you can apply from your country of birth.

If your employer has submitted your documents and you are waiting for a decisions, then technically you are not out of status, you can supply the INS receipts saying that your work in progress, but it is good to ask your lawyer what is appropriate for you.
 
i think being out of status is an issue for cic.... i don't know much but in the application form they ask you whether you were living illegally any where in he world further more ull also need to provide police clearance certificate at a later stage and for that you shud have a legal status in that country where you have resided for more than 6 months..
 
Not true, if you are out of status, you can still get the police reports from FBI, they have nothing to do with your status. I am not sure for other countries because we were talking only about the US.

CIC has a rule, your stay in US must have to be legal for a year and if you became out of status afterward, you can still apply from Buffalo.
