Hi,

My name is René. I am trying to increase my CRS score to be invited to apply for the PR, as I currently have only 403 points. I recently received a job offer, and I've added this information into my express entry profile. However, for some reason, the system is not accepting my job offer as valid, so I have not been able to get the extra 50 points from this.

The job offer that I have is:

-For a full time, continuous, and non-seasonal job.
-For a job with the NOC code 2253, which belongs to the skill level B.
-For a company not included in the list of ineligible employers.

I must say that an LMIA was not issued for the job offer. However, I understand that I am exempt from needing an LMIA, as I am covered by the NAFTA agreement (I am a Mexican citizen). Also, regarding my profile, I currently have a post graduation work permit, which is also exempt from an LMIA. This work permit does not have an employer named on it, as it is open.

Does anyone know why is my job offer not valid?

Your CRS points are accurate.

You need an approved LMIA for this to qualify as a job offer under Express Entry and to get the 50 points (even though your job offer is LMIA exempt and even though you currently hold a PGWP).
 
The LMIA-exempt part would only apply if you were already in Canada and had already worked in this job for a year. It also needs to be a closed work permit, not an open work permit.

To get points from the Comprehensive Ranking System for a job offer in Express Entry, your employer will usually need to get a Labour Market Impact Assessment (LMIA).

You should only answer “Yes” to the question “Does [your name] have a job offer in Canada?” if:

  • a Canadian employer (or up to two for the Federal Skilled Trades Program) has offered you a full-time, non-seasonal job for one year or more and
  • that job offer is supported by an LMIA, OR
  • the job is exempt from needing an LMIA.

Why does this don't apply to my case?

Because you have an open work permit and your employer is not named in your work permit.
