I'm hoping someone can calm my nerves.

So I applied for Outland- spousal on April 2015. I actually applied while on turkey with my husband
I flew back in May for school.
Returned back to my husband in August and I've been with him ever since just because I couldn't handle being far away from him.

We are still waiting for our PPR and hoping to get it soon. But I'm worried it's taking long because i am not waiting for him in canada (which is absurd)

Can anyone shed some light if this will affect our application or not? Also I am a Canadian citizen so I don't think I'll need an ARC
 
A Canadian citizen can sponsor while abroad, so you should be fine. The visa officer may ask you for proof you will be returning to Canada.

Where did you get the idea you'd need an ARC? That's only for foreign nationals who need permission to return to Canada, due to getting deported, criminality, etc.

There could be many reasons why it's taking the time it's taking. If you return to Canada, you can order notes and see what's going on with it. I think some companies can order the notes on your behalf because you are out of the country, but they charge a fee. Or you can get a friend or family member to order them. http://www.cic.gc.ca/english/department/atip/requests-atip.asp

I am also living abroad with my wife while we wait out the process. We have been able to order and receive notes just fine without using a company or family and friends.

I didn't even think about that bro LOL. They probably don't realize you're not in Canada.

You're not supposed to be able to order them if you're not in Canada.

Oh i must of read it wrong here on the forum once. That's what I get get for reading late at night. Thank you though. I'm in touch with my MP and she's good on telling me what is going on with my application and where we are in terms of processing. (Security is in process right now)

It's not a loophole. A Citizen can order notes even if he/she is not living in Canada. It would have to be done through Access to Information Act, which costs $5. Ordering it through Privacy Act is free, but must be residing in Canada.

The only requirement is to be a canadian citizen, they don't care where you live. I ordered my second set of note while i was in Thailand and no issue at all.

Yep that's the way I understand too. If you're not a canadian citizen or a canadian pr then you have to be in Canada. For exemple, if someone comme to Canada on a TRV is canask for gcms about is file only if he is inside Canada.

If you are not a Canadian citizen or PR and are outside Canada, and you are trying to get information about someone else, you'd need a representative as this falls under the "Access to Information Act". If it's about yourself, it'd fall under the "Privacy Act" and you should be able to get the information anywhere. This part isn't that clear, but it would make sense.

If you are a Citizen or PR, you can get the info no matter where you are. Phew.

Does that sound right?

Privacy Act can only be used if the person who's information is being requested is inside Canada.
