Have they found some loophole around the US/Canadian immigration or is this merely filing for Work permit/LMIA?

the employer to incorporate a subsidiary in Vancouver --> Could be legal. They are basically asking Employers to open a subsidiary in Canada so that they can transfer Trump-affected H1b employees to Canada using Intra Company Transfer working permit. However Canada is getting stricter day by day for ICT and is asking for LMIA in most cases.
