Dear Leon , Zardoz , Msafiri and other knowledgeable members,
I have a bad situation in holding my PR status .
I have already done a report on my situation , but it was not descriptive and clear enough so I started a new post to make everything clear .Any body can help ?
My family and I( wife and a 12yrs. old girl) immigrated to Canada on 2003 , and on 2008 , I renewed my PR card , so my current PR card is issued on Dec. 2008 and valid till Dec. 2013 .
From childhood , I was having a known eye illness named Keratoconus , which the only final treatment is cornea transplant . I undergone the cornea transplant in 90's for both eyes .
Early 2009 , I was having a return in old eye problem as follows :
My vision started to drop dramatically and a white spot appeared on my left eye and got bigger and bigger as time went by , it was known as HYDROPS and meant that my cornea was near to be teared off , and a sever chance of starting rejection of transplant .
So based on the ophthalmologist idea , I was obliged to have a treatment road map towards re-transplantation on my eye .
Checking the waiting list for cornea transplantation in Canada , I found that the waiting time may be some 1.5-3 years , which I definitely could not handle , with a teared cornea and losing my job , and I could not afford living in Canada in that situation . I consulted my ophthalmologist in home country , he suggested to do the transplantation in home country with waiting list as short as few months to max 9 months .So I decided to go to my home country to be treated and could afford living costs and receive help from my family and parents .
Returning my home country in early 2009 , I was under constant observation and control of my ophthalmologist , and the HYDROPS was being treated for a chance of healing , but after several months of treatment , the final decision of the ophthalmologist was the re-transplantation , so my name went to the waiting list on Feb . 2010 .
After few chances of receiving a cornea , and losing the chance due to the internal eye high pressure ( which prevents the surgeon to make any surgery on an eye with high internal pressure) , finally I got the re-transplantation on July 2012 .
From July 2012 to August 2013 , I was under constant and very regular monitoring of my ophthalmologist ( Due to the fact that for cornea re-transplantation the chance of rejection is much more than a first time transplant ) prohibiting me of having long term absence and travels , and my eye suture were gradually being removed( to adjust the post operation vision acuity ).I was strongly recommended by my ophthalmologist to follow his regime of treatment and suture removal for him to be able to adjust the vision correction by selective suture removal .
On August 2013 , , I was assured for a stable eye condition by my ophthalmologist .
There are still few sutures in my eye , but can be easily removed in Canada( they are not main sutures and after one year of operation , they would have very light effect on chance of rejection or visual abnormality) .
On August 2013 , I returned to Canada to live forever , few days after arrival , I visited a Canadian Ophthalmologist , and he referred me to the hospital for suture removal , and follow ups for my surgery , I rent a long term apartment , my daughter started the school and myself am looking actively for job and training courses .
After this long story , I had a problem entering to Canada during my long absence from the country ( I could only stay in country for 150 days during past 5 years which is not adequate for PR status holding )
At the border , My family and I were directed to the immigration office and an officer asked me why I have been abroad for such a long time , and if I have business outside Canada , I told her that I had very serious eye problem which led me to corneal transplant , and I was obliged to attend my ophthalmologist very regularly in my own country of citizenship .
She told me " NO , you have not decide to live in Canada and are living abroad so you won't be able to comply your residency obligations " I asked to show her my medical documents , but she refused and told me "I am writing your situation and you need to show your medical documents to the officer , although I am sure that the officer won't accept " and started typing some issues on the computer .
So here are my questions :
1- Has she reported me as a person who is NERA to loose his PR status ?( I did not receive any written documents from her , not she asked me to appeal for anything Just let me go out . )
2- If yes, what shall I do ? and how I can understand if she has reported me ?
3- If no , Shall I fill the application for PR renewal based on my aforementioned history and documents ?What is the chance for refusal of renewing my( and my family , which are my wife and a 12 yrs. old girl) PR cards ?
4- If they accept my reasons , will they accept only MY OWN PR Renewal ? My wife and daughter are financially dependent to me and we all live together , so they were accompanying me during my absence .
5- I really don't want to lose the PR status , overall , what shall I do now ?

Your story sounds incredibly odd. If you were living in Canada between 2003 and 2008, why didn't you apply for citizenship?
Also, you left Canada in early 2009 because the waiting list for a transplant was too long (1.5 years), but didn't actually get your transplant until 3.5 years later.

Regardless, you are fortunate to have managed to get back into Canada now. My advice would be to not apply for your PR card renewal until you are back in status.

Thank you for your comment, I tried to be as descriptive as possible .
Between 2003-2008 I did not meet the obligation ( 3 of 4 years for citizenship) but met the PR obligation( 2 of 5 years)
I actually left Canada on early 2009 and came back on August 2013 .
That is the fact .in the detailed history I was explaining the details of my activities during absence and why the transplant took so long to happen .

Still same idea?Any chance for me filling the PR renewal application ?

As you say you got extensive feedback on this including that you were not reported...with respect maybe best to get a legal consultation on this. Why can't you wait for 2 years before applying for a PR Card?

Agree. It doesn't sound like you were reported. Stay in Canada with your family for two years and then apply to renew your PR status.

And don't leave Canada unless you are holding a visa-exempted passport and/or valid PR card.
