What a great forum! Let me say that my question is simple yet I could not find an answer for it so I hope someone can help me.
Me and my husband are permanent residents in Canada. I have children from ex-marriage, they are 18 and 19 years old. They live in Cairo Egypt with their father (my ex-husband). There was no custody order for the children issued to me or o my ex, we just verbally agreed that they would live with him. When me and my husband applied for immigration, we have included them in our application as non-accompanying dependant children and they have undergone the medical check with us. Now I want to sponsor them, so my question is: does cic require a permission from their father for them to immigrate to canada if they are 18 and 19 years old? And is it a general canadian immigration rule applicable by all canada visa offices in all countries or does it differ from country to country? Thank you.

1. The 19 year old is an adult in all provinces so does not require permission from the custodial parent to emigrate.
2. Depending on the Province where you reside, the 18 year may or may not be an adult and would require permission from the custodial parent.

Thanks PMM, I'm in Ontario however I think that this parental permission depends on the regulations of the visa office in Egypt. What do you think? I've read the guide specific to africa region (where it lists egypt) on the cic website and it says that if you are divorced or separated, a notarised declaration from the other parent is required for the dependant children. It did not specify an age so could it be untill 22 years old (according to their definition of a dependant child)?

Nope, CHC may not understand it, but under Ontario law, both children are adults and can make their own decisions.

Thanks again PMP, sorry to ask again but what is CHC? And is Ontario law the one applicable when it comes to immigration not the law of the applicant's country of citizenship?

Canadian High Commission, it is the law of the province where the person's is destined regarding age.
