Hi,

I received an EE CEC ITA (June 2020) after my PGWP expired (May 2020).

Therefore, I could not apply for a bridging work permit after submitting the PR application in July 2020.

Since then, I have no income and cannot receive CERB while remaining within Canada for the PR final decision.

(Ps. I had applied for a visitor record before my PGWP expired; after waiting for 6 months, CIC issued a one-month visitor visa, and it expired in December 2020.)

On Jan 8, 2021, CIC announced that expired PGWP holders in 2020 could have chances to restore their work permits.

However, it states, "you must have a valid temporary status."

My question is: Does my implied status in the waiting final decision of PR consider a "valid temporary status?"

If not, should I apply for another visitor record?

Thank you very much for taking your precious time to help with my question.

Did you apply to extend your visitor status before your visa expired in December 2020?

The CEC application does not give you implied status.

If you did not apply to extent your visitor status before your visa expired in December 2020, then you are now out of status in Canada and need to apply to restore your status.

Dude, there is no such thing as implied status while waiting for EE PR decision. Implied status is earned after applying for PR via EE, only after successfully applying for BOWP, to which you were never eligible.

You are currently in Canada without status, you do NOT have implied status, YOU SHOULD KNOW THAT. Hence, your only option would be to apply for Restoration of Status, and then you could technically be eligible to apply for an extension of your PGWP.

SO NO, you are not in implied status, hence you do not have a valid temporary status as you are currently out of status and should have left Canada as of last month.

Valid temporary status implies you have a study permit or work permit. However, I am not sure if visitor visa qualifies as a temporary status.

Why did they issue you only a one month visitor visa? Was it tied to the expiry date on your passport.

Thank you so much for the help. I'm applying for the restoration of my visitor visa now. It was expired on Dec 27, 2020.

I have one more question.

Now I'm applying for the restoration of my Visitor Visa, and the submission list requests Proof of upfront medical exam.

* Explanation: When I did the Wizard CIC questionnaire, it asks "Have you had a medical exam performed by an IRCC authorized panel physician (doctor) within the last 12 months? (required)," and I answered "Yes," which was the one I did 6 months ago for EE CEC (PR) application.

What does it mean now? I'm perplexed.

Should I do another medical exam again for applying for Restoration Visitor Visa even though I did a medical exam 6 months ago for PR?

Or it means I can upload the upfront medical exam form for PR that I did 6 months ago?

Thank you very much for taking precious time to help with my questions.

My passport expires in 2028, which is 7 years away from now.

I actually have no idea. I waited for the visitor record for 6 months after submitting it.

And I finally received the visitor record on Nov 30, then the expired date is Dec 27.
