My step daughter moved to Canada with her mother, who's mother (childs grandma)is a canadian citizen, in Dec 2011.
My partner who has parental responsiblity in uk agreed to this, as long as said child who is 15 returned to uk every year for 3 weeks in summer holidays to visit her dad and siblings, They both signed a legal document agreeing to this.
We are now been told that his daughter wont now be able to leave Canada for a holiday for another year and 3 months, due to her awaiting pr.
We would be greatful for some information regarding how accurate this information is?
Finding information on the net seems to be hard to come by, and relations with childs mother is at an all time low.

Something doesn't make sense.

It should not take a year and three months for a dependent from the UK to obtain PR. It should only take a few months. (Is she applying for PR or citizenship? Do you know for sure?) Didn't they file for PR status when she arrived in December 2011? If so, then she should have PR by now. Plus CIC does not provide exact processing times - so it would be impossible for anyone to say exactly how long something is going to take.

You're not being told the whole story and/or information is being withheld.

To maintain her PR status, your daughter only has to live in Canada two out of every five rolling years. So once she has PR status, there's certainly nothing keeping her from taking several trips out of the country per year.

Thank you for your speedy reply, we are most certainly not been told all the correct information I fear, but trying to do anything about it now she's in Canada seems near on impossible.

They are definitely applying for PR, and to be honest her mother was in Canada the summer before they went so I'm certain she will have started motions rolling then although she never even told my partner they were actually emigrating until the sept.There explanation is my step daughters mother was unaware prior to leaving uk they would have to put in 2 years in before been allowed to leave, obviously we find this hard to believe thus leading to the breakdown in communications :(

So if im reading this right as my step daughters grandmother is a Canadian citizen it should not take as long for her mother and herself to gain PR? My step daughters mother also has another child who's 3years old would this make a difference to the PR ?

As unlikely as it is ,if they are still awaiting PR would my step daughter be allowed to leave and return for a holiday ?

Unfortunately the answer is "it depends".

Do you have any information about how they are being sponsored? Has someone sponsored the ex through family class? Or has she applied to immigrate independently? Without more information, it's going to be extremely difficult for anyone here to provide more information.

If they have applied "inland" through family class, then it's technically true they shouldn't leave the country until they have PR and the process is quite lengthly. However as UK passport holders, it's fairly low risk to leave and then return. But in order to apply inland, someone would have to sponsor them. And it's unlikely the grandmother qualifies to sponsor them (remote chance depending on what other living relatives she has). It's also interesting that the ex is applying for PR and can't obtain derived citizenship from her mother (i.e. the grandmother).

Long story short, without more information about how they are applying for PR (which stream), if they are being sponsored (and by whom) and when they officially submitted their applications - I don't think any of us here can be of much further help. Any chance you can get your hands on this info?
