I worked during 7 years for a Distributor of a brand of scientific equipment back in Chile, I'm Field service tech. This brand has the headquarters in the US and a subsidiary in Canada. This is a triangle.
I have a job offer and even I signed a contract to work in this subsidiary in Canada, I want to apply under Intra-Company transferee, the Canada-Chile Free Trade agreement says that rules for intra-company transferees are the same that NAFTA.
So!, I know my case is a bit complex and that's why I'm looking for someone who can advice me with a bit of cold mind and knowledge. If my previous employer is a DISTRIBUTOR, can I apply under this modality?? This is what it said in the Cic page:
"4.1 What requirements apply to intra-company transferees?
- enterprises in the U.S. or Mexico and in Canada have a parent, branch, subsidiary or affiliate relationship"
I understand that a Distributor is not a branch, or a subsidiary but it is a Affiliate with a relationship. What do you think???
On the other hand, I can't find a representative that can help me with this, I need someone with real experience on free trades and intra-company transferees:
I already tried:
- Ferreira and Koach: They told me in theory it could be but they don't have enough experience to deal with this... At least they were honest
- Campbell Cohen: They told me that it can't be because the name for the subsidiary in Chile is not the same that in Canada, so they offer me a LMIA... I felt like they just wanted to sell me a LMIA...
- Canada Nordic: Worst experience ever...
What other representative can you advice me, I don't care if they are consultants or lawyers as much as they really know about what we are talking about
