Dear Seniors:
Good Morning:
writing this matter on behalf of my friend .My friend is in Canada on visit visa.He is from india & before coming to canada he was living another country for almost 6 years.and during 6 years he never gone back to india. when he was living in another country he got skype (internet marriage) with girl who was living in india and now there is no more any relation with them. when he apply for Canadian visit visa he mentioned his status as married and mentioned her wife name in form he reached canada and fall in love with canadian citizen girl. now he dont have any relation with her internet marriage wife .now he want to get marry with canadian citizen . how he can do this because in immigration record he is already married.
N. B : the internet marriage is not valid in Canada and the country where he was living 6 years before coming to Canada.
Seniors please help us and give solution .

Firstly, is your friend a Muslim?

Based on what I know:
If your friend or his wife had registered the marriage.... or if there is any legal document which states he married the lady..... whether in India or in the country where he has been residing since the last six years.... then he would have to obtain a decree of divorce/nullity of marriage regardless of whether he now has relations with his wife or not.

In India.... a proxy marriage via Skype is legally binding

Without knowing the full circumstances, the marriage laws applicable to your friend, and whether the marriage is legally valid or not, it will be incorrect to assume that the marriage is not recognized in another country. This can cause problems later and even raise red flags.

My suggestion is that your friend should seek legal opinion from lawyers who handle Marriage Law matters.... in India.... and also in the country where he resided for six years

yes he is muslim.
there is no legal documents plus skype marriage was not legal in the country where the groom was at the time of marriage so no document over there too..he just mentioned in his visit visa application that he married and mentioned his wife name and didn't attached any married documents with his visa application

It is now NOT the question that either internet marriage is valid or not. As your friend himself has already declared in CIC records that he is married at the time when he applied for a visit visa, he also mentioned her name as his wife in the forms SO he now cannot get married to another girl unless he first file a divorce and legally finish his relationship having a document in hand.
Lets assume that your friend just ignore this point (divorce papers) and get married to the Canadian girl and apply for another visa (which ever e.g sponsor, pr, inland, work permit etc) or any other document related to CIC saying he is newly married and was previously unmarried, the application will be rejected instantly and he may also face a BAN to enter into canada for upto 2 years.
The reason would be misrepresentation and it is consider as a crime (giving a false information in cic forms). So no matter what the nature of the marriage was as he has already declared himself as married and provided a wife name. he must have a document that he is no longer married now (divorce) to proceed further in canada. without a divorce his new marriage will also be considered as a "marriage of convenience" (marriage fraud) and cic may also take legal action against him.
