Dear Seniors:
Good Morning:
writing this matter on behalf of my friend .My friend is in Canada on visit visa.He is from india & before coming to canada he was living another country for almost 6 years.and during 6 years he never gone back to india. when he was living in another country he got skype (internet marriage) with girl who was living in india and now there is no more any relation with them. when he apply for Canadian visit visa he mentioned his status as married and mentioned her wife name in form he reached canada and fall in love with canadian citizen girl. now he dont have any relation with her internet marriage wife .now he want to get marry with canadian citizen . how he can do this because in immigration record he is already married.
N. B : the internet marriage is not valid in Canada and the country where he was living 6 years before coming to Canada.
Seniors please help us and give solution .

If his marriage is legally binding in India it is also legally binding in Canada, he will need to get a divorce before he can marry anyone else. I'm not sure what you mean by "internet marriage" though, to me that sounds like a non legally binding marriage? Since he would not have been able to sign the paperwork or anything. Though to be honest, my knowledge of wedding traditions in India is virtually nil. Hopefully someone who knows what you are talking about with the "internet marriage" can chime in.
 
it was marriage through Skype .Groom was not present in indian at marriage time and even after that till to date plus the country where groom was at the time of marriage the skype marriage is not legal .
 
So I did a little research - turns out skype marriages are a real thing, and they are legally binding in India. So, he needs to get a divorce before he can think about marrying anyone else in any country.

True Canada does not allow proxy marriages. But that only means you can't get married by proxy while one of the parties is in Canada. If a proxy marriage is legally recognized in the country it took place in, then it is a legal marriage and Canada will recognize it as a legal marriage.

So there are only 2 possibilities here:
1. Get a divorce finalized, marry Canadian gf, then apply for PR
2. Live with Canadian gf for 12 continuous months, then apply as common-law for PR. If applying under common-law, it does not matter if one is legally married to someone else as long as the relationship is no longer continuing.
