Hi. I hope that somebody will be able to enlighten me on what to do. I came to Canada a year ago as a student hoping to find greener pasture after passing my LPN. Indeed I passed which was great news. However, I got pregnant and I'm on my 8th week. My student visa expires 9 months from now. Me and my boyfriend (Canadian citizen) wanted to get married in the hopes that I can stay here and be a family. Unfortunately, I have doubts that he will be able to fully sponsor me as he has a lot of loan debt.. literally like collection agencies are calling him. I have no idea as to the extent of his problem and how much he owes but I know it might be a lot. Will he have problems sponsoring me in the long run because of debt problems? If not, if all else fails, I give birth here in Canada and my child becomes a Citizen while I on the other hand is still under a student permit, will I be sent back to my home country? Or can i apply for a "humanitarian consideration" as by that time the visa expires, my child will be less than 2 months and I have not finished my Course Program.

A great advice is highly appreciated.

I do not believe the load debt will be an issue. The only thing he can not do is go on welfare. Where is your home country?
 
I don't see H&C working for you based on the information you have provided.

Your best bet would be for the child's father to sponsor you provided your relationship is ongoing. You would need to be either married or common law (have lived together for a year) for this to be possible. He can sponsor you if he's in debt. He just can't be on social assistance / welfare or bankrupt.

Before you marry him, you really need to sit down and have a talk about the extent of his debts. This is an incredibly important thing for any couple to do before they get married.

Note that these days study permits become invalid once you have stopped attending school for 90 days or more. Also, just having a Canadian citizen child won't allow you to stay here.
 
Hi. The relationship is ongoing which is a good thing. The only concern I have with the sponsorship is if he is qualified eventhough he has financial problems. Thank you for the reply.
 
He will not even need to indicate he has any debt in the PR application. CIC does not care about personal debt.

Hopefully you have provincial healthcare, as delivering a baby in hospital can be incredibly expensive.

Find out. You are having a child with him and are considering marrying him. No offense but it's really not indicative of a serious relationship if you have no idea of the extent of his debts and his true financial situation. These are things that partners talk about as they plan for their life together, especially with the financial ramifications of having a child on the way.

Also, if he sponsors you, CIC may call you for an interview; if they ask you about these things and your answer is "I don't know", you could face real problems with your application.
 
Note that while CIC doesn't care about debt, and there is no minimum income requirement, they may ask for some proof of income. Other sponsors were asked for proof of income like payroll stubs, etc. As long as he has some income, it should be fine.
 
I think you need to plan for the high cost of your child birth.
Depending on where you are from, you may not have your PR processed at a stage that will allow you to apply for provincial healthcare coverage.

Also, think thoroughly about your relationship with the child's dad without putting the Canadian PR in the picture first. It's a life long commitment for a marriage (unless you have been common law with him for a year already which I doubt if you have no idea on his financial status).
And if he sponsors you for your PR application, he will be responsible for you if you claim welfare within 3 years of your PR. I am not sure if someone in a lot of debt will want to take on that.

I dont know whether this service is still ongoing but it might be worthwhile checking out as it was set up a couple of years ago to assist women in Toronto who did not hold any immigration status in Canada as even though you are on a student visa that will expire and you may be in limbo depending on whether you progress a PR application.
