Hi all,

My wife, a Canadian citizen is sponsoring my PR while I am in Canada on a Visitor status. The visitor record is about to reach the expiry, and I've submitted an application to extend my visitor status, and this application is in processing. I didn't manage to do it 30 days ahead as they ask. The PR application has been officially received, but is not yet processing.

My question is, does the application processing mean I can wait in Canada, even though the visitor record says I need to leave? I am under the impression I should not leave while an application is processing.

Thanks in advance for any help you can give.

You have implied status until the decision on the visitor status extension is made. If you have applied for the Open Work Permit as part of the PR application, you also have implied status from that.

Implied status means you can remain in Canada until a final decision on your application is reached. If the application (visitor status extension *or* OWP) is denied, you may be required to leave. If it is approved, you can remain until the OWP or visitor status expires again if it is not renewed.

Thanks! This is what I thought, but I'm glad to hear someone say it explicitly.

You also will have implied status from the work permit unless it gets returned. That is why extending your visitor status was a good idea.
