Dear All,

I have a question regarding my spousal sponsorship application and my current status in Canada.

I was studying at university in Canada until I graduated in November 2023. Earlier this year, I had to extend my Study Permit to ensure that my status remained valid while I graduated. I requested an extension because I wanted to join my graduation ceremony to receive my degree in November 2023, but I actually completed my studies at the end of August. The officer granted me a study permit extension until Feb 28, 2024. My understanding is that the IRCC will consider September 15 as the day my studies ended (I received my final transcript) and that means I will only have 90 days from that date to stay in Canada or change my status (December 15).

During my studies I was married and just applied for PR through spousal sponsorship. My application was submitted on November 16, 2023.

My question is do I have to change my current status back to visitor since I may not receive my AOR before the 90 days are up?

Also, I plan to travel to my home country, the US, for the end-of-year holidays. I may receive my AOR before then so I can apply for an OWP right away, but that OWP may not be accepted in time for me to gain maintained status. Is there a strong risk that I will not be let back into Canada if I keep my study permit instead of changing it to visitor status?
