Inland sponsorship - questions about OWP/study permit/visitor permit

Hello,

My wife is currently a foreign exchanged student, she holds a valid study permit until september 2015 (it was approved prior to the new rules on June 1 2014). The issue here is that she won't be able to go back to school this year because we are expecting a child within the next 5 months.

We filed our sponsorship app in september 2013, AOR on the 17th of september. We did not send the OWP application along with the sponsorship application, so she does not have implied status yet.

1. Is her study permit still valid since it has been approved prior to June 1 (keep in mind that she won't be actively in school).
2. If not, should we try to get her a visitor visa? How long would this take? and how long it is valid for?
3. Or we apply for the OWP right now?

Has anyone in this forum experienced the same situation?

I hate to even suggest this, but...call CIC and ask them; then call back two more times and take the answer that is in the majority (at least 2 out of 3) LOL!

Ok...some people here have reported that as long as the OWP reaches CIC prior to the person losing their status (so long as the Inland application has in fact been received), it will still give the applicant implied status. However...

1. Since your wife is no longer attending school, and won't return this year, her status may expire if CIC gets wind of her break in enrollment. OWP could be the magic ticket here for her.

2. Only if the CIC call centre agent tells you that she cannot submit OWP now to gain implied status. No idea how long that would take anyway.

3. Yes, if CIC agrees that she can in fact apply now, even though she's not eligible until she has AIP...just like all other Inland applicants that DO submit OWP with their Inland applications.

If she has no plans to resume her studies, I'm assuming she has no plans to work in the near future either. If that's the case, she should just apply to change her status to visitor, as it's cheaper.

Perhaps, but an OWP is automatic, in that it doesn't need to be 'approved', like a visitor extension does. It also doesn't require the person to ever even work!

The OWP is $155 , which is a real bargain.

I know it doesn't ever require a person to work. My point was that since she won't actually need an OWP, she can save $55 and apply for a change of status to visitor. Anything to not give CIC more money

so I just called CIC, the agent said that I cannot send the OWP until AIP .

He said my best option will be applying for visitor visa, which takes about 15 days minimum to get approval using online app.

Request a year in the visitor app and include proof your inland PR app, like AOR or the fee receipt. That should cover you through to the end of the PR processing so you won't need to extend your status again.
