My common law partner and I are unsure about what to do here.
I want to stay with him during the waiting time and I'm afraid that wont happen if we apply Outland at the London visa office. I had troubles a the border for visiting too much.

If we decide to go inland and I apply for an open work permit at the same time, I'm obliged to stay with him while the application is being processed, right? For a Danish citizen to apply inland is going to take over a year I'm assuming.. We are so unsure so I'd really appreciate some help.

Everything you have said seems to be spot on. Hard to advise you exactly what to do. I think if I were in your shoes and I assume your in Canada right now? If I have assumed right then I personally (not all will advocate this) would choose an inland application. You are required to be with him for the duration of the application and since you have had past issues with border control if you do decide to leave for any time and are not readmitted then your application will be deemed abandoned.

I guess the only downside with an inland app is you are more than likely going to have to stay in Canada until it is complete. Stage 1 and Stage 2 together are 14 months (Although fingers crossed you might be there in 10-12months). That and you can not appeal a negative decision but inland has a much higher success rate than outland.

However I do stress it is only advice and I am sure others will promote outland.

So I have to stay with him while its being processed and will not be Able to leave canada? That's fine with me I'm wanting to avoid going through that "being apart" issue.

Now I want to work asap so if I apply for an open work permit with the pr application, tut will allow me to work during most of the waiting period?

Yes after Stage 1 you can get OWP with an inland application only. Certainly there are benefits to an inland application, these we are not refuting. The trouble is potentially with your visa. If EVER you must leave Canada, for emergency, because CIC tells you to, etc etc, your application is at great risk of being cancelled, and then you start over again.

Well as I said you can leave Canada (that's your perogative) BUT on re-entry in to Canada it is also the border official's perogative to refuse you entry (given you have had a minor run in previously they MAY refuse you). I only mention the downside in case anything happens in your "home country" I.E family issues but obviously you have weighed those risks up.

As for working, if you apply for an OWP, at this moment in time CIC states stage 1 is 6 months for stage 1 approval (it might be quicker but I am not well versed in how quick) once stage 1 is complete at that point you can start working. You can alternatively seek a job with a LMO but this will be quite difficult to obtain but not impossible.

Do you mean that if they tell me yo leave the country after my work visa expires then it'll be in trouble? I'm not too sure if I understand. I can still apply for an inland sponsorship application while I'm on an one year international experience canada visa, right?

Yes you can apply for another type of Visa whilst on an IEC Visa and if you have an application in process, No you wont be in any trouble. Your application (inland) will give you implied status providing your in Canada.

Not sure what your last point was/ is. As long as you are always in status and not inside Canada "illegally", CIC will not tell you to pack up and leave, why would they? You are doing everything right. Just make sure you file your inland application (if that is what you choose) before your IEC expires.

Even if it does expire and you are out of status and apply for an inland app then you "should" be fine but it is a bit riskier. Staying in status will guarantee that everything will run pretty smoothly. How long does your IEC have left to run? If you have your inland app running alongside your IEC then possibly you will be able to work continuously.

Really? I think I won't though as soon as my work visa rubs out in feb next year i will wait until I'm eligible for an owp! Ok I think we are going with inland. My family is well aware I won't be coming home if something s to happen. I don't like that thought, but being away from my man and not really having any connections back home except family I'd way rather stay here.

Now would you recommend I get a medical examination done before we send off the application? And if so how's that working? I live in Calgary so can I just go to a walk in clinic or?

Sorry for all these q's I really appreciate your help!

My apologies I must have clicked on something wrong. My iec visa runs out early February next year!

Well if you applied tomorrow (I know that is not realistic) you would have your OWP May 16th and be free to start work then, so I guess you would have 3 months of not being able to work, obviously the longer it takes to gather all your documentation the longer the date of being able to work will be pushed back.

As for medicals, no you must choose a physician on the CIC designated list. Here is a link for the Canadian Physicians you can choose to use. Forgot to add you must do the medical before you send you application and send of the receipt the doctor gives you. I would also do the medical as late as possible as it is only valid for 1 year (later you do it will remove the need for a 2nd medical towards the end of your application). Dont forget the Police checks you must obtain for every country you have lived in since 18 or the last 10 years (which ever is sooner) for MORE THAN 6 MONTHS.

Yes, that's kind of what I thought! You are a star! Thank you so much. I've walked around almost going insane trying to think or figure out how to deal with it. So thank you :) inland is definitely the answer. So once my iec expires I just stay right? Jut making sure.

Shall do!

Just one last thing.. What do you recommend as proof?
I've gathered a folder with some plane tickets of his nd mine, letters sent to me from my family with his name n too, statemes from his and my family, rental agreement, post eing sent to our address, a dozen picture. My laptop screwed me over however so all hat logs from messenger and Skype are gone snd I only have one greeting card sent from him! Oh and a letter stating that he's joint o my bank account. Do you recommend nothing else?

Thanks once again

I just noticed now on your 1st post you stated your common-law. You will have to document you have lived together 1 YEAR (even if it is 11 months and 3 weeks don't send your app until it is 1 full year, it will be refused).

Recommendations for proof (since it is common-law it will need to be extensive) Photo's of both you with friends, family, taking holidays (things that show your a couple and everybody knows about you both) letters from friends, family verifying your relationship ( maybe 2 from family and 2 from friends) gift receipts, cards, cinema tickets, restaurant receipts. Then things that show financially you are in the relationship together like joint bank account, lease agreements, utiliy bills addressed to you both, Phone logs between the both of you. I personally send documentation that provides it has been an on-going relationship i.e 3 phone bills for every year have been together. You trying to tell a story so try to refrain from dumping them with millions of pages of information, try to send a sample that backs up your relationship. I personally never sent any computer info like E-mails (they were personal) and I never sent any Yahoo logs (I never ever thought to save them lol)
