Hey everyone, thanks for your help in advance.

Here’s our situation: I’m a Canadian citizen, and my common-law partner is on PGWP, which will expire in April 2027. We have lived together for more than a year, and we were living at my parents' house. However, since September, we haven’t been living together because I need to finish my studies in another city, while he’s working in Toronto (during the period where we are not living together, he will continue to live at my parents' house, and we still have the same address).

We’re both still in Ontario and plan to live together again in March 2026. During this period, we’ll continue to meet regularly on weekends and holidays.

In this case, if I plan to sponsor him for permanent residency, should we apply through the outland stream instead? Since the Family Class doesn’t strictly require us to live together the whole time, I’m wondering which option is more appropriate.

If outland, is he still eligible to apply for an OWP if he's PGWP is expiring. Thanks!!!

Is it only a requirement to be cohabiting if you submit an inland (SCPLC) application. You cannot submit an Inland application.

Since you are no longer living together, be sure to include evidence that your relationship is continuing, albeit in separate homes.

Is there any risk associated with submitting an Outland application even though both of us are currently residing in Canada? Would it be fine as long as we explain why we are not living together at the moment and show our intention to live together again as soon as possible? Should we indicate a specific timeline in our application? Also, for the address, can we still use the same one even if we are submitting an Outland application? Thankssss

Do you have proof of living together for a continuous year in a common law relationship (things like shared finances, being listed on each other’s insurance, etc.)?
