Dont worry
You may still have enough time untill you get your AIP which you can give to CBSA to stop the deportation order....did cbsa initiate the monthly reporting when your husband lost his refugee case? If your answer is no then you are 100% safe cuz that gives you 3 to 4 safe months till AIP. But...if your answer is yes then you should hope that their paper works and delays in issuing the deportation order buys you enough time untill you get your first stage approval which is most likely will happen earlier...
We haven't heard anything from CBSA yet, my husbands lawyer contacted him this week. Should we expect to get a letter in the mail from CBSA?

Generally, AIP is six months after you file, which would be May 2013. However, because you have a failed refugee case it will likely go for an interview. Normally, CBSA will defer enforcement of a removal order as long as their is an in-process in-Canada class sponsorship application. The AOR will provide evidence that you've filed such an application.
We filed December 2012, received AIP in Early January... Do you think we'll have enough time? Should we expect to hear anything from CBSA?

I assume you mean you received AOR in early January since AIP usually takes 6 months.

The problem is that the policy is just that - policy and it is up to the discretion of the officers involved.

Someone with AIP who has a criminality issue will probably be deported. Someone without AIP but with a spousal application in process may be deported - it really is up to the discretion of the CBSA officer.

AIP is no guarantee against deportation. Then again, not having AIP is no guarantee they will deport you either. That's why no one can say definitively what will happen. It depends upon the specifics of the case and the CBSA officer making the decision.

Alright! You must consider your husband a luky person..my sister inlaw got her cbsa letter within first month of her refusal and my wife after 3 month but their appeal went through..in both letter they had been schedualed for an interview 45 days later..yes you will get a mail from CBSA, it s kinda amazing to see you have not got it already, because the time gap that appeal gives you wont stop that cbsa from sending their interview leter to initiate pre removal process! anyway,my understanding is that your AIP will be receieved before your cbsa interview at the airport rd office.

Have just looked at the spreadsheet and it looks promising! Some people who applied in May and got AIP in October seem to be getting their DM - hopefully I will soon! :D

No, it won't matter. You aren't on social assistance, which is what matters. Nothing says you cannot owe taxes and sponsor.

You can pay CRA online and then get Option C issued (just show to the immigration officer that you're paying them back)

Hello All,

I've been following this thread for a while and I've just decided to join because it's nice to be able to share information and support with all of you guys whom I believe are in the same situation - waiting months after months.

This is my info:

Application received Sep 20, 2012
Processing started Dec 12, 2012

That's all I've got so far from my eCas. Hopefully, good news aka AIP is coming soon!
Btw, I wonder if they will email us about the AIP or it will just arrive in the mail?

Thank you,
:D
