Dear all

I am writing this question on behalf of my daughter and her fiance!
They are both in Europe and are ready to send their apps outland.
That's no problem as they are qualified as common law.
My question is this:
They want to go to Canada now because my daughter (Canadian citizen sorry i forgot to mention this in the beginning) is having a job offer in Canada and she cannot miss it. So they think that they should both go to Canada now and apply inland. He of course will not work but he is from a visa exempt country.
I have been hearing that when apps are done inland and the Principal Applicant is in Canada after sponsor approval the CIC may allow him to get a temporary work permit until he gets (if he gets) COPR.
Is this a factual procedure or did I got it wrong?

I will appreciate your lights here folks!

That is true, after Stage 1, the applicant can get an OWP (if he applies for it and pays the application fee).

However, Inland can sometimes take a very, very long time. We're talking years and years and he can't travel outside Canada without risking the application.

They should do more research on the pros and cons both Inland before using it. It's really more for people who require a visa or are out of status in Canada.

You also have to take into account that if you are living in Canada and applied outland and get called for an interview you have to bear all costs for travelling which can be alot if your office is far!

When we say years, how many years we mean? I know that when you apply inland, it takes 17 months to 2 years.

The inland sponsorship approval generally takes 6-8 months at present at which time the sponsored person can apply for an open work permit unless they apply for one with the Family Sponsorship Application and then they would get it at the same time as they receive the approval in principal (AIP). The only time it would take longer is if the file was transferred because the sponsorship was in question and then the time span between waiting and possibly getting an interview could be 3 months to 2 years depending on which office is doing the paperwork.

There are pros and cons with inland and outland applications. It is suggested in the literature that inland applications are used mainly in relationships where both the spouse and the sponsor are already living in Canada and since your daughter and her partner have both been living outside Canada, when they do come to cross the border to Canada they will be asked what their intentions are. What I think a good idea for you to do is to familiarize yourself a little more about these two different types of applications before you give any advice to them. Also, there is a strike right now that is causing longer wait times in some areas overseas. So I wouldn't expect any definite answers to anything right now. I wish your daughter and her partner the best of luck.

True, with the strike action, Inland apps are still waiting on AIP from October 2012.....
