Hello,


I have a question about sponsoring my wife. we wish to do an inbound sponsorship because we do not want to be apart.

I am a Canadian citizen born here. My wife is a US citizen born there. she got to stay for 6 month with me and we have finished our application and need to send it out. My questions are

1 it says she needs to be in good standings in Canada, She is getting close to her 6 month allowed time to stay here (there is no visa needed to enter Canada from US) If we file now there is no way we will hear back from Immigration Canada in the time she is allowed to stay. Will she need to go home or, filing allowing her to stay until we here something from the government? Is there a forum we need to fill out so she can stay longer?

2 after waiting 16 weeks from the FBI we found out that they cant read the fingerprints and have to do them again. can we send prof we have done this and currently waiting once again from the FBI? Or do we need to wait another 16 weeks before we apply?

1. Don't apply inland. Outland is by far the better option for US applicants. You can be in Canada and apply outland.
2. Many applicants submit their application with a letter showing that they have applied for the FBI check. CIC is aware of the delays involved in getting it.

You can apply online to extend her stay. If you don't, she'll be out of status.

1 - 3 words: don't apply inland. US citizens can have their PR in less time than it takes to get the OWP for inland! She needs to renew her visitor status online before it expires (it's called "change conditions or extend your stay as a visitor") and she can "visit" you in Canada while the outland application is processing. She can renew her visitor status until she has her PR.

2 - Yes, you can just show proof of the PCC request with the application. I hope this time you sent multiple sets of prints with her FBI request.
 
You should seriously consider submitting an Outland application, which can be dome even if the applicant is in Canada, or wishes to enter Canada, as a visitor, during the process. Most Americans are completing the entire process in ~6-8 months!

1. She can apply for an extension, explaining that she has applied for spousal sponsorship. Just include proof, with the extension request. this is very common, so CIC will likely approve the request.

2. Include a letter with the application, explaining what has happened (along with proof that you have sent a new request to the FBI).

Bottom line...Do NOT submit an Inland (Inbound as you call it), unless you want here to be `trapped' in Canada for 2-1/2 years.
