I am trying to get back into Canada after a drink driving charge 3 years ago. I am engaged to a Canadian and discovered last minute last year after applying for a teacher exchange that I was inadmissible. I was not driving my vehicle and was asleep in a sleeping bag in the back of my car inside in a tiny wee village. I have requested all court documents as sheriff intended only to give me points on licence and no record. I got a record because of a process called the totting up procedure. I have requested a meeting with the Canadian High Commissioner to discuss Common Wealth and reciprocal understandings as he has a criminal record for actually driving drunk ( two times over the limit ). Can you tell me what the difference between a TRV and a TRP is please. I want to visit this year and at the same time apply for the ability to stay longer term????? Any help would be gratefully received.

Anne

You don't qualify for a TRV since you are inadmissible to Canada.

A TRP is the right thing to apply for if you want to enter Canada while you are still inadmissible and visit temporarily. None of us here can tell you if you would be approved or not.

Unfortunately you won't be able to apply to stay long term in Canada until you are no longer inadmissible. To be no longer inadmissible, you will have to wait until 5 years have passed since the completion of your penalty / sentence. At this point you will be able to apply for rehabilitation. You can find detailed information about the rehabilitation process here:

http://www.cic.gc.ca/english/information/applications/guides/5312ETOC.asp

Good luck.

I am sure it is the TRV that the immigration lawyer said I could apply for. My circumstances are that I was asleep in the bacck seat of a car and was given the criminal record because of something called the totting up procedure. Can I apply for the visitor permit? I am still unsure which is which. I think the visitor permit takes about 11 days o process? Is this right. Thanks for your help with thhis

If the lawyer told you to apply for a TRV (not a TRP) - then I would get a new lawyer.

You need a TRP. TRP processing times unfortunately aren't published.

Right thanks. I think I will get a new one and then have alook at my options. Where will I find the information for the form TRP? Hopefully I can resolve this issue at some point. You think the TRP could take more than three months??

Thanks for all your help

anne

Information about TRPs can be found here: http://www.cic.gc.ca/english/information/inadmissibility/permits.asp

Sure - it's possible it may take more than three months. It's also unfortunately possible you won't be approved.

Good luck - hope it works out.

what formdo I fill out.

Is it the 5554 TRP???

Do I fill out IMM 1444????

This is the most confusing thing I have tries to do yet

Is this for real??? When applying for the exchange last year I realised this was a total nightmare but now it is just 100 times worse with criminality. It is impossible anyway to get into Canada although much better in the last couple of years. I am about to give up!!

You're visa exempt - right? If so, did you check with the visa office responsible for your country to see if they have a specific process you should be following? As mentioned in the instructions in the link I provided, you should to this first.

Send an email to the visa office in London and ask for instructions. Include a copy of your Court records.

I think it takes up to 28 days to get an e mail reply from the CIC in London. I was hoping someone on here might now what form to use and that I could start the process. I know how long this is likely to take and wanted t find the correct form. This looks as if it is something that I will need to use a lwayer for. I can honestly say this is the most upsetting thing that has ever happened in my life. The Canadian immigration system is impossible. I have been living with this since I met my fiancee. I am going to talk to the lawyer I spoke to last time.

This is a nightmare

Do you think it might be an idea to turn up at a port of entry and apply for a TRP?? Have you heard of anyone doing this??

Anne

Yes - it's possible to apply at the border but the chances of success are apparently quite a bit lower.

It is possible to get a TRP at the port of entry but it's a huge risk of being refused and returned on the next flight.
