Dear Sir,

i had been sponsored by my wife as a Canadian citizen and i became a PR, unfortunately we got separated after 9 years of marriage.

Currently i am living outside Canada and my PRC valid till 2024, she and my 2 kids are living in Canada - Montreal.

my questions are:

1- Can she cancel my PRC with this separation?

2- if not, and I settle in Canada in 2020 and spend 3 years, am I eligible to get the Canadian Passport to be able to visit my kids?

3- If not, Am i eligible to get a visit visa any time to visit my kids ?

Thank you

Best Regards

Yes I Landed, and I got the PRC and it is valid till 2024

As long as you were still married and together when you landed then no she can not cancel you PR. How long did you spend in Canada before you separated? If your PR card expires in 2024 you landed in 2019 and it seems like you are not in Canada at the moment you must have only been in Canada for a short while.

Actually I landed in 2014 and because of financial issues and own business i couldn't stay in Canada but we were still married and she (the sponsor) was living with me outside Canada

In 2019 I renew the PRC (using the condition that my sponsor was living with me outside Canada for more than 3 years), So Now my PRC valid till Feb 2024, but now My wife (the sponsor) is living in Canada with the kids and i am planning to settle in Canada by 2020 to continue the 3 years before the expiration of the PRC to be able to get the Canadian Passport.

Am i going in the correct path? Or should I worry about any move from my sponsor ?

She can't do anything to your PR status.

Thanks a lot, Just another question.

In case I couldn't settle the 3 years before expiration of the PRC, i cannot renew it right ?

You would lose your PR if you do not meet the residency obligation. However, you would need to be reported for breaching the residency obligation first.

You actually got quite lucky since it doesn’t seem like you spent much time in in Canada in 2014 and your wife moved abroad for you. That could have created problems for PR renewal in 2019. Would recommend you stick to your RO because you have basically no history of living in Canada.
