I applied for permanent resident as protected person in 2012. I am a convention refugee. my file was transferred to the local office in Edmonton and it will take 24 months to process my application. My wife was included in my application for permanent resident but she is desperate, she wants to be with me, she is depressed and i do as well after we were told we have to wait 2 years.. she has a visitor visa in the US and she wants
to join me in Canada and waiting until our permanent resident application is complete.

Is there any possibility that she comes into Canada through USA in any port of entry, border.. I think it is possible with third country agreement. She just want to stay with me while the processing of our file is done. Is possible? isn't it the same? I made an inland application as a protected person in Canada. I am desperate i never thought this will be a nightmare of waiting.

Comments, advices, consequences... any comment will help please ??
Thanks

What country is your wife a citizen of?

Colombians need visa to enter Canada. See if she can apply for a visitor visa from the US to enter Canada. You could call the CIC and get advice on what you can do for her to come be with you in Canada. Also, contacting your MP might help. Good luck!

As mentioned, she needs a special visitor visa (TRV) to come to Canada. You can apply for one from a USA visa office. Hopefully they will approve her for a TRV, but in my opinion I think she may be refused since they might feel she will not leave Canada after the TRV expires since she will naturally want to stay with her husband. She should try to show lots of ties (family, job, school) to Columbia that would convince a visa officer she will return there. I'm not sure if there is H&C terms to apply for a TRV.

If she just shows up to Canadian border with no TRV, she will definitely be denied entry to Canada. The only possible way will be with a TRV.

thanks for answering..

I already know that Colombian people need a canadian visa to get into Canada. if she applied for a visitor visa from Colombia they will think she will stay with me and never come back. if she does from USA visa office will do the same they will probably refuse her visa as visitor.

Is there any law that allow her to come as family reunification through the border (port of entry)??

I don't know what this is so difficult.. this just depressing me more, i can't work well.. I have been crying, damn.

Even if she applies from the US, they could still deny her based on ties in country of residence. What they want to see are significant indicators that will cause her to return to Columbia. Examples are proof of long term employment, ownership of businesses and properties, having minor dependents, proof of adequate funds, etc. Having a spouse/partner in Canada makes her ties to Canada stronger, which is not good.
Be sure to write her an invitation letter and clearly state the reason for her visit, places you will visit, how long she will stay, when she will return, etc. Just put in a strong application and hope for the best.
