Imp Question-Related to CEC application and calling spouse

Hello,

I am working under NOC 2283 category

I will be eligible to file my CEC in July,2014

My question is as follows,

1.) Should I plan to get married (Court Marriage) in March 2014 and based on my field job I call my wife for Open work permit under CIC rules..??

2.) I plan to get married (Court Marriage) in June 2014, come back to Canada in 1st week of July 2014 and file my and spouse PR together in July 2014 under CEC category. After I receive my file number in 2 months (September 2014) and then I call my wife to Canada based on Open work Permit..??

3.) Which option gives me better chance of getting my spouse visa without her being getting rejected

If you have any other suggestions...??

Hi Varun123,

With Immigration, I always try to be one step ahead since nothing is written in stone even the processing times.

So my advice would be

1. Get Married as soos as you can :) (March 2014)
2. Bring your wife to Canada with you on Visitor visa (as a dependent spouse) and apply for her open work permit when you are back in Canada. Also you can apply for open work permit from India as well but I heard the processing times are different. (I'll let other experts to comment)
3. Apply CEC in July
4. And if everything goes well with your application, you may receive AOR within 2 months (as per the current processing times gathered in this forum)

Based on my friend experience you can do either....but its better if you get married and apply for PR. And apply for spouse visa after getting married.. Spouse visa doesnot depend on above conditions..Its independent of above conditions you are giving.

I recently met two lawyers their view was as follows,

1.) After getting married if you call your spouse on visitor visa (Chances of rejection are high)

2.) After getting married, file your CEC application and after getting your file number then call your wife on Open work permit based on my NOC job gives you two advantages (1st you have NOC job and 2nd you have your file number)
So visa office has a less chance to reject your spouse open work permit application

Please give your master thoughts on this everyone

Forget the lawyers! When it comes to CIC applications it's very hard to predict the outcome so people always tend to be on the fence by saying that your wife's visa could be rejected. I've heard the same story enough times. But, you know what I had no hiccups with my wife's visitor visa.I believe you're currently on Work Permit and not a Permanent Resident already? If that's the case I would suggest you to get married FIRST and apply for CEC together with your wife as a dependent. I believe this is the best thing to do. I second everything "Iwanttoimmigrate" said. PS: Adding spouse to an existing application is being such a pain in the rear for me now. I got my RPRF and medicals request on the day of my wedding and therefore I added my spouse to my existing application after wedding. My application is getting delayed cuz of this change and it's hard to track the status and I'm still wondering when my wife will get the medical request :( . So my advice is to apply together!!!!

Yes I am on a work permit valid till 2016,

So can you tell me if this makes sense

1.) I go to India in April 2014 get married (court marriage as very short time left)
2.) I file my CEC application in August 2014 with I being the principal applicant and my wife dependent
3.) Around October 2014, I get my File Number for CEC application
4.) Around November 2014, I apply for my wife Open work permit based on my NOC job and file number (making case little strong)
5.) by December 2014 she gets her open work permit (Possibly) and then she comes to Canada latest by January 2015

Does this process make sense or you would suggest me to correct some steps

Yes this makes perfect sense. Just wanted point out that you're wasting 3 months after your court marriage. I would recommend you to apply as soon as possible. It should take only a month to gather all the documents (even for your spouse). That's just my recommendation. Everything else sounds good to me.
