Hi Guys,

Just a quick question here, does a one week visit to my partner at her country consider as cohabitation?

Many Thanks!

Yes, so long as you both stayed together in one house.

I think with information I have gathered, it's whatever you feel defines it. For us we have stayed in the same apartment for 4 weeks and didn't consider it cohabitation. We explained why in the box provided.

You can answer 'yes' or 'no' to this question. But any time you and your spouse stayed together overnight should be mentioned somewhere on the application! There are two questions about visiting; you could mention it there. However, the cohabitation they mean on this form is not the 'one year living together' cohabitation they mean for common law. Many appeal court judges have taken this question to mean any number of nights spent together. So one judge thought a week spent together should have been mentioned.
