Dear Friends

For the first question in the form IMM1344E
What should I select for
* if you are found ineligible to sponsor, indicate wheather you want to
Withdraw fees will be refunded or proceed with the application . Fees will be retained.

Please let me know.

Thanks So Much

In almost all circumstances, the correct answer is "withdraw".

Thanks but few
Experts suggested to continue with the application since I have the right of appeal to bring my wife to Canada . I am confused now

-What if I do not meet the sponsorship requirements?

If you do not qualify as a sponsor and chose to withdraw your sponsorship application, you will be refunded the fees for processing the application for a permanent resident visa and any Right of Permanent Residence Fees you have paid. There will be no decision on the application for permanent residence of the person you are sponsoring and you will not have a right of appeal. You could then resolve the situation leading to your ineligibility and reapply at a later date.

If you do not qualify as a sponsor and have not notified CPC-M of your intent to withdraw, the application of the person you are sponsoring will be processed. The visa office will likely refuse the application for permanent residence and inform you in writing of your right to appeal.

Much quicker to resubmit after fixing the problem than appeal.

I personally have put "continue with application" because the only reason I think I might be refused is because I just started a construction company so therefore no proven income right now. I had lots last year. I have a letter offering my wife and I rent free housing for the next 3-5 years, I have enough saved that is over and above what 3 years minimum income would be if I had to have an income, and also new business has a contract already. So if they refuse sponsorship it can only be for not being employed. I will therefore go get a job driving truck before her part of the application is finished and will send them notice as such.

Aaaarrrghhh

Now I am second guessing myself... Our biggest problem is it could take forever for her to get her FBI fingerprints done again if we go the other route. Her fingerprints are that hard to read.

It is quicker to get everything sent back if there is a problem with the sponsor. You can then fix the problem and reapply. Even if you choose to have everything sent back if found ineligible to sponsor, if you are found eligible to sponsor, the application goes to the visa office, and the visa is rejected there, you can still appeal.
