IMM 5604 , Sponsoring dependent child while famiy dispute is going on in courts...!!

Hi,

I canceled the family sponsorship application for ex-wife and my children after they got approval for PR visa and were asked to submit passports but ex-wife refused to continue the application, and we had some family dispute where she filed for divorce, in fact .

However, the court refused her request for divorced and until now we are legally married but living seperated and kids are with her in UAE.

I am in living in Canada and have canadian citzenship, i want to sponsor my kids only but she is not co-operating at all,

my questions:

1- can i sponsor my children who are under 18 of age, while we are still legaly married but have a divorce case in court and custody is not given to either side .

2- she is not willing to cooperate, or reply to my messages,and even refused to complete the family sponsorship at the final stage where IRCC sent us a passport request.and stayed 1 year waiting her,until VO sent us that PR visa has been expired.

3-IMM 5604 states that the parent who is not coming should sign it, but she refuses as we have divorce case in court ,court of first order gave me the right to refuse the divorce and keep the marriage in which she went for appeal.,will these things affect the Children's sponsorship by me ,

4- what can i do to make my case

5- what are the conditions to sponsor dependent child, interms of finances, income, housing..!!

1. No, as you will need full custody of the children and the ability to allow them to leave their country of residence.

There is no way for you to sponsor your children at this time. In order to sponsor them now, you would need your wife's cooperation and her written approval.

You either need to end up with sole custody of your children once this goes through the court system. Or you need to convince your spouse to cooperate and provide signed authorization for your children to come to Canada. That's the only way this will happen.

is IMM 5604 considered the official form for consent of a non-accompaning parent.?

I am working on reaching an understanding with ex-wife but that will take time, so in the mean time, if i manage to let her accept to sign the IMM 5604, will i be needing any other form from her to sign or that would be it.

i heard about some consent paper from former spouse , is that something different from the IMM 5604

If you manage to get her to sign the IMM 5604, make sure it's in front of a public notary. Otherwise it doesn't count / won't be accepted. I'm not sure what else is needed for the PR application. Wait for others to comment.
