I am so upset. I just got back from visiting with my spouse (common law, I'm the sponsor). We submitted our application for spousal sponsorship in March and have been waiting to hear back. I checked my mail and there was a letter from CIC and I got all excited and instead it was a letter asking for form IMM5409 the Stat Dec of Common Law. I did not include this document with my application because according to the CIC instructions and from what I read on this forum it was not required. I submitted all the required proof of common law documents as part of my package but not this form.

The most frustrating part is it looks to me like we are supposed to sign this form together in front of a notary as there is only space for one notary signature. I was JUST there with him in Texas not 12 hours ago and we could have done that had I known. We now have until July 9th to submit this form with original signatures to CIC and I have no idea how to do that without one of us buying a plane ticket tomorrow. Is there someone who has some advice/help with this?

Ya we got that request too. Pissed me off as well but we were lucky enough to be together. Earlier I have seen people suggest one of you goes to the notary first, have it signed and everything. Mail it ( I would do snail mail) to the other person and that person have it notarized.
On the upside, about 2 days after we emailed it (never send the original I think) we got decision made...

You can try responding and saying that you actually don't need it but we decided against stressing about it and just getting it done. I had attached a document on why we didn't attach that (and other) forms so I don't know how much discussing it again would do.

Thanks so much for your response. I wound up calling the help line and their suggestion was to respond using the online form and attach their own documentation showing that the form wasn't needed. Fingers crossed they accept it. I haven't even heard that I've gotten SA yet so I'm so confused about what is going on with our case.
