Hi Guys,

So here is my case. I plan to fly back home from Dec 5 to Feb 2, I was told by my school office my graduation letter may get released at the beginning of Feb or late Jan because of the winter break. So I don't want to submit PGWP online cuz it's so close to my return date (and I might not receiving my graduation letter by the time I return Canada), but just in case I have, I am wondering if I can still return to Canada with my study permit and visa. Both my permit and visa expire at the end of Jul 2020, so basically I have half-year left on that.

And if I could - what do I need to prepare just in case CBSA asks?

Thanks!!!!!

Congrats on graduating, I too graduted this September 2019. I would really say, don't go back home without applying for PGWP otherwise, you will not be allowed in Canada and have to apply for it, back home. I am from India, and there it takes 3 months to process the PGWP, and only after that you can come back to Canada. But as soon as you fill the application online, you are on applied status and you can go anywhere in world.
Maybe others can give more guidance than me.

That is not true. You lose your implied status if you leave Canada.

Incorrect. OP could return to Canada on their valid TRV and as said above, Implied Status ends when a person leaves Canada.

Wow didn't knew that. To be honest after applying for PGWP, I went to vacation in USA, and spend some days there and came back, just have to show my study permit and I was allowed in Canada at border. Now that I am thinking, maybe travel to USA, doesn't voids your Implied Status.

And for my friend, he went to USA and got flights from there to Mexico and Then went to India and came back to USA, and took flight back to Toronto, he was allowed on Implied Status, maybe Canadian Border Agents didn't knew he went outside of USA, and his Implied Status didn't expired.

There is no exemption for going to the US. Implied Status ends when a person leaves Canada. Either your study permit was still valid or you were granted status as a visitor when you re-entered.

Same for your friend. Note that if he had an expired TRV and took that route to avoid having to get a new TRV, he could end up in big trouble.

Yes, our study permit was valid. It is usually 4 months more than the actual study ends. So I graduated in Sept 2019, and my TRV and Study permit is valid till Dec 2019

As you still had valid study permits neither of you were on Implied Status.
