Ok so I know there is a bunch of information all over these forums but I basically got a couple of specific questions regarding the Permanent Residency and IEC.

So I am currently in my 4th year of IEC Working Holiday visa which I extended whilst in Quebec. Since it is expiring at the end of March I had applied for permenant Residency thru the family sponsorship with my common law partner. I applied back in April 2017 and I have passed the medical and just sent in the two background A forms. My fear is that my current working holiday visa will expire before I get my Permanent Residency and because I cannot extend my working holiday visa and I do not get implied status what are my options???

Did you file Inland or Outland?

If you filed inland, then if you recieve AIP before you permit expires you can then apply for an OWP based on your PR application.

If you file outland then there really is nothing you can do but quit your job when your permit expires and wait for your PR status to finalize.

What is AIP? And OWP? Sorry I am a sucker for abbreviations

AIP is approval in principal. It effectively means that your sponsor is eligible to sponsor you and you are eligible to apply for PR

OWP is an open work permit which, in this case, is only granted to inland applicants who have filed for PR. You could have sent it in with your application for PR along with the fees and it would've been processed in roughly 4 months. If you did apply inland and did not send this in with your application I suspect you would now have to wait until the AIP stage to apply for it.

So the AIP stage is basically a letter that states my spouse is approved to sponsor me - I’m guessing this is the last stage before I receive my Permanent Residency?

But if I applied for the OWP with my application wouldn’t I have to still wait till I get that AIP letter before the OWP takes effect? So it could still have been past my current visa expiry date...

NO. AIP is the final stage in assessing your sponsor. You still have to clear all the hurdles of the PR application after that, such as background/criminality/medical, etc etc etc

No, when applying for the OWP at the same time as an inland application it is linked to your PR application and processed through the pilot program. When it is not sent with the application you must wait for the letter stating you can apply for PR to apply for the OWP.

You still haven't said if you applied inland or outland.

If a person applies inland, they can include an OWP app. The OWP is not dependent on AIP and is issued within about 3-4 months of submitting the app.

If you tell us if you applied Inland or Outland we can tell you what you can/can't do. Without that info we are all just wasting our finger energy!

I started a post earlier on OWP. This is kinda similar to my situation. And am.still struggling to understand.

I applied for PR inland, I didn't send OWP in same package because I still had valid IEC. In December I applied for OWP paper application to Vergeville. My IEC expires next month(Feb). Will my OWP visa be processed in 3-4months or do I need to wait for AIP?

It will take 3-4 months. You really should have submitted the OWP app earlier, as you will not be allowed to work in the time between your IEC permit expiring and your OWP being approved.

I applied inland and i didn't apply for an OWP because i still had my IEC work permit.

The thing is there was an issue with my application which was there fault because the message in the online portal said that i had to do something but i received no correspondence from them. Looking around online several forums said that this was normal and you just wait it out.... so 3-4 months down the track i decide to give them a call and they said that they sent me a letter. To which i showed them that i had not received anything since the CSQ letter in which i applied, granted and sent back to them.

I had screenshots and even sent in a IT error as well as a email stating the problem for which they never responded to.

So i am now thinking that my whole application will be delayed because of this. So obviously my next step would be i have to apply for an OWP. and since its 3-4 processing it could be a while before i can get it.

Do i get implied status if i apply??

I'm a little confused..but it is early and I'm only on my first coffee!

So.. You have applied for the OWP or you haven't?

If you applied in April (and included the OWP app in there) and still haven't had movement on the OWP app it sounds like something has gone amiss somewhere. It would be "normal" to still be in processing stages of your pr app but your OWP app should have been processed by now.

I haven't applied for OWP..

I haven't applied for OWP..

I'm guessing you have had sponsor approval already? If so, you could have applied for the OWP when that came in.

What are you from? This is just out of curiosity as you say you're on your 4th IEC and didn't know you could have that many.. 2 of 2 years I'm guessing?

Most likely either dual citizenship (eg Aus/NZ, UK/Ireland, any combination of those) for four years, or possibly just Aus who started pre March 2015 (which would be about right for expiring soon - about to be a lot fewer Aussies in that situation, who used to have unlimited participations in their 20s).
