I need some advice...

My spouse and I are madly in love. We have been together for nearly two years and he made the trip up from the United States in October of 2011. He has been here 7 months and needs to know if he will be subject to any punishment if he re-enters the American border. We need to know if they will let him back into Canada, and if so, how long will he have to wait for re-entry? We plan on marrying each other very soon and we're wondering if we should wait until we're officially married. We plan on staying in Canada, but his family is from the United States and we would like to have the opportunity to visit them.

Another issue we have is, will he be punnished on the Canadian side of things for being in the country for so log? I know that in order to become a Canadian citizen, he has to reside in Canada for more than 3 years... Does that mean that he can't leave the country in those 3 years, or can he return to the United States for a week and return?

We would hate to find ourselves in a situation where he is unable to return to Canada and we're separated for a long period of time.

We desperately need some advice and would greatly appreciate it at this time. Thank you for reading our post and to anyone who can respond with some answers to our questions.

You should get married so you can apply to sponsor him for PR. He can not apply for Canadian citizenship unless he is a PR first.

As for the overstay, a month is not too bad but he should get his butt back to the US before he gets caught and deported. If he gets banned from Canada for 2 years for overstaying, that is how long you can not sponsor him. As for being allowed into Canada again, it always depends on the immigration officer. If they suspect that he is living in Canada more than he isn't or they think he might plan to overstay or work illegally, they could stop him from entering.
