Hello,

I’m hoping someone can give me some advice. I’m in the process of completing and submitting my husband’s sponsorship application. The problem is he is living here in Ontario with me, but his visitor visa expired in October 2018. I didn’t know we needed to extend his visa until I spoke with a lawyer in January. The lawyer told me that we can still apply from here in Canada, but we need to write a letter of explanation to explain that we didn’t know we needed to extend his visa. I’m wondering if anyone else has experienced anything similar to this? The lawyer said if our application is denied, then we can’t appeal it and won’t be able to apply for 5 years. So I’m wondering if anyone has advice for writing the explanation letter, or if my husband has a better chance if he goes back home to Panama and then we apply from there.

I appreciate any help and advice!

Your lawyer doesn't seem to be very knowledgeable. You might want to consider changing. There's no 5 years ban on reapplying unless IRCC specifically ban the applicant for misrepresentation, which is not applicable to this case, based on the information you provided.

You can still apply inland with out status. Just gather all the documents u needed and complete the papers to sent. My husband was out of status since 2015 and now were just waiting for his landing. Just explain how and why u missed to restore ur status.

Since I came I was staying at my godmother's place at (address). Before I moved in to my wife, my godmother was the one helped me with finances and a place to stay as she was treating me like her own son. Until I met my wife, we decided to move in together last September 2016, from then my wife is supporting me and helped me in every way she can. I really want to stay here and be with my wife and step son that’s why I am correcting my mistake being overstayed. I want to apologize regarding this matter and I am hoping for your usual kind and consideration. Thank you and God Bless.

Thank you so much for your reply, this gives me a much better idea for the explanation letter :) So the letter should be written by my husband right?
