So I'm applying for PR via commonlaw, and applying for an OWP as part of the process.
For implied status, will I get it either a) when they begin my application, or b) when my current permit expires before I get the OWP?

If it's a), will that override/nullify my current work permit?

If I have implied status and my OWP gets denied for whatever reason, would my implied status be taken away immediately? I'm concerned about this because I may need to rely on implied status because I don't have much time left, but if it can be yanked immediately, would I have to get out of the country at the same time too?

Has anyone here ever had problems with their employer while being on implied status? If it's as tenuous as it sounds, I can't imagine any workplace being happy that I could lose my right to work at any time.

Are you on IEC right now?

-Must be received before current status expires
-Starts from the day received at mailroom
-If your OWP app was returned for any reason you would be out of status once your IEC expires. Implied status will go away if your IEC was expired and your OWP app was returned.

OK cool, my status doesn't expire til late October.

If I find myself out of status, obviously I can't work but will I have to leave Canada immediately? Or can I remain while I find myself a visitor permit (or something)?

As a precaution you can just extend your stay as a visitor if you wanted to be fully covered. If you were out of status you'd have to apply to restore. You do not need to be in status for an inland spousal app (but wouldn't get OWP until AIP if you were out of status).

Cool, thanks for the info.

I actually have another question that you might be able to answer: I have a year's lease showing that my partner and I have been living together, but it's dated March 2018 - March 2019. Since then, it's been month-to-month (no documents showing this). Will that matter, given that it's June?

I would include an explanation and demonstrate that you've been paying rent and that the way it works is once your lease is up it moves to month to month but don't foresee it being an issue.

OK cool, that sounds good! Thanks.

Sorry to bug you again, but does this sound OK for the explanation? :

To whom it may concern,

<Partner> and I have been co-habiting in the same apartment since March 5, 2018. We initially signed a six month lease with our landlord. When that lease was up, we signed an additional six-month lease (the Addendum of Residential Tenancy Agreement included). However, once that second six-month period was up, our lease went to a month-to-month basis. Our landlord supplies no documentation for month-to-month leases. I have attached a copy of my e-transfers (the method by which rent is paid) to demonstrate that we are still paying $1200/mo in rent to <Landlord>, as of the day this application was submitted. We hope this will suffice

Thank you,

Thank you,

Not bugging me, sounds fine, and just so you know once common law has been established it is acceptable to live apart. I know that you're not living apart, but that's partly why I don't foresee this being a major issue. In Ontario I believe all our leases go to month to month after the contract is up so I'm sure this won't be the first time they're seeing something like this.

Thanks dude, you've been most helpful.

I just remember somewhere on the application there's a little checkbox that says "Are you and your common-law partner currently living together" so I figured I should cover all my bases.
Thanks!

No worries, and I think it is good additional proof for you to submit (in terms of the payments and explanation).
