I have now completed the assessment of your application for a permanent resident visa as a member of the Canadian Experience Class and have determined that you do not meet the requirements for immigration to Canada.
According to the Immigration and Refugee Protection Regulations, applicants in the Canadian Experience Class are assessed on the basis of the pass/fail requirements set out in subsection R87.1(2). The regulatory definitions and applications of Canadian Experience Class are attached.
The assessment of these criteria determines whether a worker with Canadian experience will be able to become economically established in Canada. The criteria are:
knowledge of English or French, Canadian skilled work experience, Canadian educational credentials (for the Post-Graduation Stream only).
Based on information available, your skilled work experience in Canada was classified under the occupation: Minister of Religion – NOC 4154, a Skill Level A occupation under the National Occupational Classification matrix.
Pursuant to subparagraph 87.1(2)(B)(i) of the Regulations, a foreign national is a member of the Canadian Experience Class, if they have had their proficiency assessed in the English or French language by a designated organization or institution, and have obtained proficiencies for their abilities to speak, listen, read and write that correspond to benchmarks, as referred to in Canadian Language Benchmarks 2000 for the English language and Niveaux de competence linguistique canadiens 2006 for the French language, of (i) in the case of a foreign national who has acquired work experience in one or more occupations that are listed in Skill Type 0 Management Occupations or Skill Level A of the National Occupational Classification matrix, (A) 7 or higher for each of those abilities, or (B) 6 for any one of those abilities, 7 or higher for any other two of t hose abilities and 8 or higher for the remaining ability.
According to your test results from the International English Language Testing System (IELTS), taken on 11 September 2010, you received the following scores and the corresponding benchmarks in the Canadian Language Benchmarks 2000 (CLB Level):
Speaking: 6.5 = CLB Level 8 Writing: 5.5 = CLB Level 6 Page 2 of 5
Reading: 5.5 = CLB Level 6
Writing: 5.5 = CLB Level 6
Listening: 4.5 = CLB Level 4
You therefore failed to meet the official language proficiency requirement for persons with qualifying Canadian work experience of Skill Level A of the NOC under subparagraph R87.1(2)(b)(i). You did not declare language proficiency in the French language on your application.
Should you have different or additional information, you may wish to submit a new application and pay a new processing fee. Any new application will be assessed according to the Immigration Act and Regulations in force at the time that the new application is filed.
The Right of Permanent Residence Fee that you have paid is refundable. You will receive a cheque from this office within a few weeks or when it is available from our accounting department
